We are looking for experience in the pharmaceutical industry to play a key role supporting the Company’s future growth and core mission to find, fight and follow serious diseases working cross-functionally to grow our existing products and to bring our pipeline to patients.The successful candidate can look forward to building strong relationships across the organization, “plugging into” cross-functional information flows and workstreams to understand business objectives and bringing their legal expertise and strategic thinking to proactively identify and mitigate risks in the evolving field of diagnostic and therapeutic radiopharmaceuticals.Attorney with 10 - 13+ years of relevant pharmaceutical/biotech industry experience to join the LANTHEUS Legal Department as Senior Corporate Counsel responsible for commercial matters, including providing practical, solution-oriented legal advice relating to investigational and marketed products and drafting and negotiating contracts. Candidates should have experience counseling in-house business partners on the sale and marketing of pharmaceutical products, scientific exchange, patient support programs, launch readiness, life cycle management, customer and other contracting and other legal matters of importance to the life sciences industry. Experience counseling on market access matters and on medical devices is a plus.This position will report to the Senior Vice President, Legal Affairs and will be based in Bedford, Massachusetts.This position will serve as a primary legal contact for marketed and investigational products, advising internal groups including research and development, commercial, including field sales, medical affairs, market access, patient support, commercial operations and others. The role will collaborate extensively with our Ethics & Compliance team and will be the legal contact for medical materials review as well as promotional materials review. This position will also be a key contributor to our commercial strategy and will involve advising on customer contracting, including contracting with health care professionals and other customers.Substantive working knowledge of US Federal and state laws and regulations relating to the pharmaceutical industry, including without limitation US Federal healthcare program requirements under the Food, Drug and Cosmetic Act, the False Claims Act, the Anti-Kickback Statute, the Transparency (Sunshine Act) Provisions of the Patient Protection and Affordable Care Act, US Antitrust laws and Medicaid Best Price requirements is expected, as is awareness of current enforcement trends and compliance expectations. Experience working globally, including a familiarity with laws and regulations applicable to the pharmaceutical industry outside of the US, is a plus.Candidates for the position are required to have a JD from an accredited law school and a valid license to practice law. Massachusetts license is preferred.Key Responsibilities:Partnering with and advising senior business leaders to facilitate compliant development and execution of brand strategy and achievement of brand objectives, including (i) ensuring the business is kept abreast of relevant legal developments, (ii) advising on strategic brand and cross-functional business operation plans, tactics and execution, including launch planning and strategy and associated product related offerings, (iii) identifying and analyzing risks and proposing appropriate, pragmatic, risk-based solutions to facilitate decision making, and (iv) providing specific US legal advice.Drafting, negotiating, reviewing and interpreting agreements associated with the business, including agreements with health care professionals, vendors, licensors, collaborators, consultants, manufacturers, distributors and speakers.Primary areas of focus include (i) providing pragmatic and risk-based legal advice during development and execution of commercial and medical strategy and business / brand plans for products and product candidates, (ii) interactions with customers, including health care professionals and patients, (iii) product promotional materials and initiatives, (iv) patient interactions and patient support programs, (v) advisory boards, speaker programs, and publications, (vi) medical education initiatives and scientific exchange, (vii) serving as a member of promotional and/or medical affairs materials review committees, (viii) negotiating commercial contracts and advising on market access strategy, (ix) other general contracting (procurement, clinical and supply), and (x) reviewing and advising on media relations materials, investor presentations, press releases, web sites and other company communications.Professional Skills:High level of professionalism and integrity, sound judgement and a strong commitment to ethical conduct.Strong organizational skills and ability to work independently managing multiple and sometimes conflicting responsibilities simultaneously while meeting high quality and timeliness standards in a dynamic, fast-paced environment.Sophisticated emotional intelligence, strong interpersonal skills and proven ability to work collaboratively in cross-functional/multi-disciplinary teams.Strong verbal and written communication skills.Ability to effectively communicate legal advice in a simple and straightforward manner, including the ability to: (i) understand and digest complex scenarios, (ii) manage differing opinions, ambiguity and conflict effectively, (iii) identify and evaluate relevant legal issues and risks, (iv) propose practical, risk-based solutions that take into consideration the relevant business objectives, (v) communicate issues, risks, and solutions clearly and concisely to lawyers and non-lawyers and (vi) escalate issues appropriately.Ability to exert “soft influence” and build consensus without direct line management oversight.Commitment to proactively identify opportunities for improvement and engage with appropriate stakeholders to propose solutions.
