HDR has an excellent opportunity for an experienced professional to join our Water Business Group (WBG) in the role of Commercial Manager. The successful candidate will work primarily on a portfolio of HDR WBG projects where HDR is a design subcontractor to a construction general contractor on water infrastructure design-build projects. The Commercial Manager is responsible for assisting in establishing, negotiating and ensuring compliance with the terms and conditions of HDR design contract, assisting in negotiating the terms and conditions of subcontracts, and documenting and agreeing on any changes or amendments that may arise during the implementation or execution. The Commercial Manager manages the non-technical aspects of the projects to which they are assigned in close coordination with the Project Manager and Design Manager. He/she will also provide guidance and assistance and will collaborate with Project Managers on scope management, change management, schedule, risk, and other contract matters. WBG Commercial Manager responsibilities include:

General

Collaborate closely with Project Manager and Design Manager to trend cost, schedule and risk activities and to ensure contract compliance.Collaborate with other WBG Commercial Manager(s) to implement effective commercial and change management best practices on design build projects.Engage on water infrastructure projects as requested during pursuit and delivery phases of project.Collaborate with other business group Commercial Managers as requested to ensure enterprise-wide alignment and delivery of commercial management services.Support Construction Management and Program Management engagements by assisting with commercial management issues.

Project Pursuit Phase

Collaborate with APD Director, pursuit team and project manager regarding preparing responses to solicitations (RFQs, RFPs and interviews) while maintaining relationship(s) with contracting partners. Specific focus to be teaming agreement and subcontract terms and conditions, prime contract terms and conditions, and quantifying/qualifying HDR scope of work/fee.Collaborate with WBG APD Director and WBG General Counsel regarding teaming agreements and design subcontract terms, scope, and performance requirements.Review RFP for all performance standards and requirements and collaborate acceptance or mitigation approach with other WBG Commercial Manager(s), WBG Counsel and prime contracting partner.Collaborate with APD Director, other WBG Commercial Manager(s), Project Manager and WBG Counsel to prepare for and navigate HDR risk review/mitigation process.Develop processes for non-technical contract administration necessary to ensure project team adheres to the requirements of the contract. Train the project team regarding these processes and execute implementation of these processes.Assist APD Director and Project Manager in addressing/responding to all project insurance requirements, especially PSPL in compliance with HDR corporate policy.Work with Project Manager and team to develop, present, negotiate, monitor/trend and procurement phase design budgets and prime contractor.Assist Project Manager in managing procurement phase design scope/budget and potential changes thereto.Assist Project Manager and design team regarding commercial engagement with technology providers, equipment manufacturers and suppliers.Collaborate with PM to establish, trend and administer the project risk register.Review all contract documents to minimize conflicts and ambiguity.Collaborate with Project and Design Managers to quantify and qualify HDR design scope of work for both preconstruction and construction phases of the contract.

Project Delivery Phase

Oversee non-technical aspects of on-going Contracts, including compliance with the Contract documents to ensure that the requirements of the contracts are implemented and maintained. Review contract performance by monitoring compliance documents, schedules, and deliverables.Assist in drafting of subcontracts for design or engineering services. Administer current prime contract and flow down to subcontractors, task orders and modifications. Administer and oversee contract performance by monitoring compliance documents, schedules, and deliverables and requirements.Develop processes for non-technical contract administration elements to adhere to the requirements of the contract as necessary. Train the project team on these processes and execute implementation of these processes.Review all contract documents to minimize conflicts and ambiguities.Conduct contract awareness and lead change management efforts with key project staff.Assist PM in preparation of correspondence and maintain records necessary to ensure the effective administration of all Contractual matters.Facilitate the preparation of contract changes and administration, review and settlement of contract change negotiations and participation in the development of affirmative claims and support to the project and the legal department on defense of claims.Assist in the preparation of change order and claim logs.Assist the Project Manager in contract close-out procedures to ensure that all terms and conditions of contracts have been complied with prior to final payment.Ensure all warranties, bonds, insurances, guarantees, etc. are in place and maintained and updated in accordance with the Contract and are in compliance with the both HDR and the Client's requirements.Monitor schedule for submission of deliverables and other contractual notices and certifications.Monitor project budget and earned value in coordination with Project Manager and Design Leads. Assist with identification of project financial issues and recovery options.Prepare/distribute monthly Commercial reports as requested.Collaborate with Project Manager regarding overall monthly Progress Report.Participate in monthly and quarterly project review meetings and report out on cost, schedule and risk issues as necessary.Perform other duties as needed.

Required Qualifications

A minimum of 10 years' experience in Architecture/ Engineering, Design-Build, P3, project management, construction, project controls and/or staff leadership or equivalent.A bachelor's degree in engineering, architecture, business, law or equivalent.Working knowledge of Architecture/ Engineering/ Construction industry contracting practices in the country(ies) the Senior Commercial Manager works in, applicable government and commercial regulations and practices, policies, procedures and work practices.Working knowledge of project controls, project management, and project estimating software tools such as: Primavera 6 (P6), e-Builder, Quick Base or Primavera Unifier.Experience in development of fee estimates, drafting contracts, administration and negotiation of change orders, effective correspondence, planning and scheduling.Experience in claims which may include claims defense, claim production, claim negotiation/resolution, and claim prevention.Ability to work well in a high performing team structure in a fast-paced environment.Experience and/or working knowledge of negotiation of contracts for architecture/engineering projects.A positive professional reputation as one who can deliver quality, cost effective projects.Self-starter; good communication and people skills.Must be committed to quality and improvement and promoting HDR's values.Ability to teach, lead, and mentor others.
