OverviewThe Director, Assistant General Counsel role provides legal advice and counsel in the areas of real estate including leasing, development, acquisitions and land use.

The ideal candidate has a range of real estate experience with a special focus on strong operational partnership with business leaders.

Reports to and receives assignments from the VP, Assistant General Counsel. Works closely with growth and transactional leaders with a focus on expanding Novant Health and its related entities’ offerings.

Qualifications

Education: Juris Doctorate from an ABA-accredited law school, required.

Experience: 7+ years experience in the practice of law.

Licensure/Certification: Active license to practice law, in good standing with jurisdiction in which licensed, required.

Additional Skills (required):

Substantial commercial real estate experience, including:

drafting and negotiating commercial leases, subleases, easements, declarations, owner association documents and other related title matters; commercial real estate acquisitions and dispositions, including drafting and negotiating purchase and sale agreements and closing documents, and managing transaction closings; real estate matters related to mergers and acquisitions, including due diligence review and negotiation of relevant provisions of related acquisition/sale agreements; advising clients on lease interpretation and enforcement issues.

Substantial real estate leasing experience.

Skills for problem solving, teamwork, and developing innovative solutions. Excellent communication skills required. Ability to handle unusual, demanding and unrelated tasks and strong organizational skills.

Speed to Market: Effectively works in a fast-paced work environment to deliver results.

Problem Solving: Strong analytical, critical thinking and creative problem-solving skills.

Judgment: Demonstrated ability to act independently upon information and make decisions that achieve optimal results.

Additional Skills (preferred):

Experience with the Anti-Kickback Statue (AKS), the Stark Law, and other regulations

Experience with commercial construction law issues, including construction contract negotiation, development and cost-sharing arrangements, and contractor dispute resolution

Experience with non-profit entities

Foundational knowledge of healthcare operations

Develop policies, practices, and procedures that have a significant impact on the Provides reliable and well-researched advice on all manner matters.

Advises on specific health care issues such as HIPAA Privacy Rule, the False Claims Act, the Anti-Kickback statute, government and confidentiality issues.

Reviews and prepares agreements and contracts

Assists in the development of new policies, procedures and forms for the organization.

Maintains professional competency, according to department policies, procedures, and protocols.
