Overview:Provide a broad range of preventative regulatory and risk services related to long-term care to develop and implement best practices company wide, promote compliance with governing regulatory laws and guidelines, and minimize company regulatory and legal exposure.
Regulatory Compliance:
Oversee all State and Federal regulatory and survey enforcement matters applicable to long-term care and communicate with such agencies, as warranted.
Risk Management:
Identify, evaluate, and manage potential company legal risks; develop and implement solutions to mitigate potential legal exposure, particularly in the areas of medical malpractice, survey and regulatory non-compliance. This includes managing administrative (survey) and other legal claims against the company; interfacing with outside legal counsel; administering the company’s global risk management program; managing and analyzing risk management data; conducting risk management educational programs; and complying with risk management related standards from accrediting or regulatory agencies.
Attorney Directed Audits and Investigations:
Direct and oversee legally led internal audits and investigations, collaborating with compliance and clinical teams, and external counsel as needed. Develop Company policies and procedures to mitigate legal risks and enforce compliance with all applicable laws and regulations.
Legal Nurses:
Manage the company’s legal nurses and assign them tasks, as appropriate, to assist with all duties.
Reporting:
Prepare needed internal reports on risk management and survey/regulatory matters, attend board committee and other meetings as assigned.
How You Will Make a Difference:
Assist the Vice President of Litigation & Risk Services in handling and managing aspects of preventative, potential, and existing regulatory and legal risk matters company wide.
Identify, manage, and mitigate legal and regulatory risks in operational and clinical care areas, conduct root cause analysis, and provide creative and well-informed solutions.
Oversee internal legal investigations and notifications to relevant authorities when necessary.
Represent the Company at internal and external audits, inspections, and investigations as assigned.
Plan, develop, and present risk prevention training and education to administrative personnel, nursing staff, and other department personnel.
Assume risk management on-call responsibility for the Company as part of a legal on-call rotation.
Respond to and assist with daily questions and needs from the clinical and administrative staff, as well as company management.
What You Need to Make a Difference:
Juris Doctor (JD) degree required from an accredited U.S. law school (nursing degree or other clinical experience in the long-term care sector a plus).
Minimum of eight (8) or more years of relevant healthcare regulatory experience in a law firm and/or healthcare system, required.
Must be a member in good standing of the Kentucky Bar (TN Bar admission a plus, or at a minimum, eligible for TN Bar limited certificate of admission as in-house counsel).
Must have long-term care/nursing home experience.
Must have nursing home risk management experience.
Must have strong clinical knowledge.
Knowledge of healthcare liability and risk management practices.
Excellent verbal and written English communication skills.
Demonstrated intermediate to advanced skills in Microsoft Word, Excel, PowerPoint, Outlook, and Internet navigation.
