JOB SUMMARY:

We are looking for a fast-thinking privacy attorney who can take ownership of privacy as a subject matter within the legal team. The Privacy Counsel will play a pivotal role in ensuring our company's compliance with data privacy laws and regulations across the United States, including privacy by design across our products and services. This position requires a strategic thinker with a strong legal background in data privacy who can lead initiatives, provide expert guidance, and collaborate with various stakeholders to manage privacy risks effectively.

KEY RESPONSIBILITIES:

Data Privacy
  • Serve as the lead data privacy subject matter expert for the company's United States entities, providing accurate and timely counsel to business departments and management.
  • Analyse and control advice on the compliance of the activities of personal data information processing projects within the framework of Data Protection Impact Assessments / Privacy Impact Assessments and propose remedial measures.
Operational Framework
  • Review and analyze legal, regulatory, and commercial developments in the privacy arena to ensure an up-to-date data privacy operational framework, manage risks, and develop forward-thinking advice on market-leading approaches to privacy compliance.
  • Identify discrepancies or lack of conformity for processing activities and suggest remedies.
  • Identify the risks generated by a data processing activity and apply effective risk management techniques.
Contract Negotiation
  • Negotiate and draft data privacy and security provisions in contracts, including data privacy addendums (DPAs), licensing agreements, sourcing and procurement agreements, technology agreements, partnership and joint venture agreements, terms of use, and other agreements with B2B partners and vendors.
Policy Development
  • Spearhead drafting and updating U.S. cybersecurity, data protection compliance, and privacy policies as well as guidelines, training tools, and practices across the company to develop scalable frameworks and approaches to assist the organization in achieving its strategic objectives while complying with privacy regulations.
  • Provide guidance and develop written policies to address inquiries from various teams across the company based on the issues presented.
  • Ensure compliance with policy requirements and integrate privacy by design principles into all aspects of the vehicle manufacturing and distribution processes.
Cross-Functional Collaboration
  • Work cross-functionally with global teams to complete Data Privacy Impact Assessments (DPIAs), data flow maps, processes, procedures, and privacy by design implementations.
  • Guide information technology teams and business leaders on the privacy, confidentiality, legal, and other risks associated with the development, operation, and implementation of technology systems and innovations, and work collaboratively with business leaders to develop practical solutions to address those risks.
  • Collaborate with marketing, sales, aftersales, development teams, behavioral analytics, and advertising to ensure privacy compliance.
Third-Party Data Requests
  • Manage and process all third-party data requests, including Data Subject Access Requests (DSARs), from contractors, vendors, impacted individuals, and other external parties.
Disputes, Breaches, and Investigations
  • Advise on data protection and data privacy disputes, providing risk analysis, managing relations with lawyers, collecting evidence from operational staff, drafting letters and formal notices, and drafting and validating transactional protocols.
  • Provide advice and guidance in the event of data breaches.
  • Interface with data protection regulators; support the business with any related investigations or requests as required.
General Legal Support

- Assist with other legal matters and special projects as assigned.

Position Requirements

QUALIFICATIONS:
  • A minimum of 8 years of legal experience, with at least 5 years in data privacy, data protection, cybersecurity, and compliance programs. This can include a combination of corporate and law firm positions. Automotive industry (including electric vehicle) background a plus.
  • Juris doctorate (JD) degree and California Bar membership. Applicable advanced degree(s) a plus.
  • Certified Information Privacy Professional/United States (CIPP/US) a plus.
  • Broad knowledge/experience in the following areas: the CCPA, the California Privacy Rights Act of 2020 (CPRA), industry best practices, and also familiarity with the evolving privacy regulatory landscape including the Colorado Privacy Act (CPA), Connecticut's Data Privacy Act (CTDPA), the Utah Consumer Privacy Act (UCPA), and the Virginia Consumer Data Protection Act) (VCDPA).
  • Experience negotiating DPAs with data processors.
  • Experience cultivating relationships with internal stakeholders, parent company legal leaders, outside counsel, and relevant external governing and regulatory agencies.
  • Strong interpersonal skills with ability to communicate and manage well at all levels of the organization.
  • Ability to work under pressure and with tight deadlines.

  • Creative problem solver; not afraid to think outside the box.
  • Meticulous and thorough attention to detail.

VinFast Auto is committed to fair, equitable, and transparent compensation. Final compensation will be determined by various factors such as your relevant work experience, education, certifications, skills, and geographic location. The pay range for this position is $140,000 - $185,000.
