Job Description:
This position performs complex, senior-level legal work and is based in the Office of General Counsel (OGC) - General Law Section. Primary focus is on employment law and administrative law matters, including open meetings, rulemaking, open records and ethics matters.
Independently plans, organizes, and delivers legal services, interprets laws and regulations, prepares legal documents, consults with attorneys in the Office of Attorney General, provides legal advice and counsel, and may assist in investigating cases. Interacts with Commission staff to gather and evaluate evidence in connection with claims or litigation. Works under limited supervision, with responsibility for initiative and independent judgment, as well as collaboration with other staff. Responsible for pertinent OGC performance goals, objectives and metrics. Reports to General Counsel.

Work Hours and Telework: Standard office hours for Commission employees are 8:00 a.m. to 5:00 p.m., Monday through Friday. Our agency offers alternate schedules for employees, as long as it does not adversely affect operations and service levels, and standard hours of operation are maintained. The Commission may also offer telework based on the agency's approved Telework Plan. Alternate work schedules and telework may be discussed with the hiring manager during the interview process.

Essential Job Duties:
- Responsible for handling a broad range of employment law and administrative law matters, including open meetings, rulemaking, open records and ethics matters.
- Handles employment-related claims and disputes, including participation in matters filed with the Texas Workforce Commission or EEOC.
- Reviews and investigates employment-related claims or litigation involving the Commission and its staff, including witness interviews and depositions.
- Supervises and handles open records requests and rulemaking efforts by the Commission.
- Manages matters referred to the Office of the Texas Attorney General.
- Advises on legal matters and on the interpretation and application of agency regulations and state and federal laws, including the Administrative Procedure Act, the Open Meetings Act and the Open Records Act.
- Prepares and presents training on areas of primary responsibility.
- Prepares research memoranda, legal opinions, pleadings, briefs, and reports, and assists in reviewing and drafting policies and procedures.
- Reviews bills filed during the legislative session, and provide testimony as required.
- Reviews drafts of laws, rules, and regulations affecting Commission operations.

Qualifications:
Minimum Qualifications:
- Graduation from undergraduate school with a bachelor's degree and from an accredited law school with a Juris Doctor (JD) degree. Minimum 7 years' experience in practice of law in private practice and/or government, with experience handling employment and administrative proceedings, or other relevant experience. (TRANSCRIPT REQUIRED WITH APPLICATION)
- Licensed attorney in good standing with the State Bar of Texas.
- Experience handling with administrative law and proceedings, and with agency employment disputes desired.
- Experience implementing or using an automated docket management system desired.
Knowledge, Skills, and Abilities:
- Working knowledge of state and Federal employment law, the Texas Administrative Code, and the Administrative Procedures Act.
- Knowledge of legal principles, practices, and proceedings of state and federal laws, rules, and regulations, as well as agency administrative rules and regulations.
- Skill in legal research, writing, and analysis; identifying and solving complex problems; interpreting and applying laws and regulations; and, using judgment to identify courses of action.
- Ability to: manage a complex workload and the staff involved in performing the work; prioritize workloads and meet applicable goals, objectives and performance metrics; and, effectively recruit, retain, develop and mentor staff.
- The ability to communicate clearly and concisely, both orally and in writing.
- Ability to take initiative and work independently.
- Ability to work effectively on a team.
- Ability to address issues/concerns in a professional manner.
- Ability to maintain working relationships with internal/external stakeholders.
- Ability to respond to high pressure situations and meet changing demands and timelines.
- Ability to understand and explain complex issues, including litigation, regulations and standards.
- Proficient in the use of computer systems utilizing Microsoft Office Suite and database systems.
- Demonstrate excellent organizational, communication and writing skills.
