S/he will provide legal guidance to the Lincoln Financial Group business segments that are responsible for providing Lincoln’s retirement plan products and services. His/her focus will primarily be the product/solution development regulatory and statutory requirements applicable to these offerings in qualified retirement plans, 403(b), 457 and other deferred compensation plans. Products and solutions will often be insurance products, securities, or participant level experience focused solutions aim at improving their retirement outcomes.What you'll be doingWhat you'll be doingProvides legal advice & support on: the development & maintenance of LFG's retirement plan products & services; marketing, sales & distribution to new & existing clients; & the legal & compliance aspects of servicing clients & their retirement plans.Identifies and directs strategic process improvements that significantly improve quality across the team, department and/or business unit for assigned area(s) of responsibility.Drafts and negotiates:Service agreements with plan sponsors;Settlement agreements with plan sponsors or participants.Other contracts with service and distribution partnersNegotiates, drafts and/or approvesDispute resolutionRegulatory disputesCommercial claim disputes.Advocates RPS's positions with third parties such as federal, state, and local regulatory bodies and agencies.Oversees the production of legal research including the use of electronic, hard copy, and Internet resources, as necessary.Directs/executes approved strategy decisions and contributes to strategy creation for assigned area(s) of responsibility.Analyzes and communicates changes/developments in the laws applicable to retirement plans (legislative, regulatory, case law).Identifies and communicates legal exposure and risk in a timely and proactive manner to internal key senior stakeholders.Reviews documents and communications prepared for distribution to and/or use by plan sponsor and participant clients.Reviews, advises, drafts, and negotiates contracts and ancillary documents within assigned area(s) of responsibility.Advocates RPS's positions with third parties such as federal, state, and local regulatory bodies and agencies.Selects outside counsel and directs them on various legal projects, as appropriateMaintains knowledge on current and emerging developments/trends for assigned area(s) of responsibility, assesses the impact, and collaborates with senior management to incorporate new trends and developments in current and future strategies.Provides subject matter expertise to team members and applicable internal/external stakeholders on complex assignments/projects for his/her assigned area(s) of responsibility.Directs/executes approved strategy decisions and contributes to strategy creation for assigned area(s) of responsibility.Provides strategic direction to build and enhance the capability for his/her assigned area(s) of responsibility.Maintains current knowledge of legal developments and trends, assesses the impact, and ensures that new trends/developments are appropriately incorporated in current/future strategies.What we’re looking forWhat we're looking forEducationUndergraduate degreeJ.D. from an American Bar Association (ABA) approved school and a Member of the Bar in good standing is required
Experience10+ Years as a retirement plans attorney preferably either at a law firm or financial services company 5 – 7+ Years’ experience with the requirements applicable to product/solution development in the retirement plans context, such as ERISA title 1 considerations, 33 Act Considerations, Advisers Act and state department of insurance issues5 – 7+ Years’ experience with the requirements applicable to qualified retirement plans, 403(b), 457 and other deferred compensation plans 0 - 1+ Years of Insurance and securities law experience a plus Application DeadlineWhat’s it like to work here?At Lincoln Financial Group, we love what we do. Pay is based on non-discriminatory factors including but not limited to work experience, education, location, licensure requirements, proficiency and qualifications required for the role. The base pay is just one component of Lincoln’s total rewards package for employees. In addition, the role may be eligible for the Annual Incentive Program, which is discretionary and based on the performance of the company, business unit and individual.
