Role Objective:

The Pre-Litigation Case Manager is responsible for managing all aspects of pre-litigation personal injury cases, ensuring that each file progresses efficiently from the point of client retention through to settlement or the transition to litigation. This role requires a proactive approach to case management, ensuring timely communication with clients, coordination with medical providers, and strategic handling of cases to maximize recovery for the client.

Key Responsibilities:

1. Client Interaction:

• Serve as the primary point of contact for clients throughout the pre-litigation process.

• Provide regular updates to clients regarding the status of their cases.

• Educate clients about the pre-litigation process, setting appropriate expectations.

2. Case Management:

• Review and organize incoming case files upon retention, ensuring all necessary documentation is collected.

• Coordinate with medical providers to ensure timely treatment for clients and work with the appropriate internal teammates to obtain necessary records and bills.

• Monitor client treatment progress and assist with scheduling appointments as needed.

• Prepare demand packages for insurance companies, including a detailed account of injuries, treatment, and damages.

• Review, summarize, and provide chronology of the client’s medical treatment for the assigned attorney ensuring all incident related injuries are identified and appropriate treatment received.

• Strategically identify additional insurance policies as applicable, to ensure that our client’s recover the maximum amount possible.

• Establish subrogation claims for all applicable health insurance carriers ensuring timely response to lien updates, investigating ERISA applicability and ensuring a final lien has been requested and/or obtained prior to settlement negotiations.

3. Negotiation and Settlement:

• Engage in negotiations with insurance adjusters to secure the best possible settlement for clients under the guidance and instruction of the assigned attorney.

• Present settlement offers to clients, providing clear explanations of the potential outcomes after thoroughly reviewing the offer with the assigned attorney.

• Work directly with the settlement team, if necessary, to obtain reductions as well as to prepare files for settlement disbursement, ensuring all liens and outstanding balances are resolved.

• Collaborate with attorneys to review cases that may need to be escalated to litigation.

4. Documentation and Reporting:

• Maintain accurate and up-to-date records of all case-related activities in the case management system.

• During weekly file reviews with assigned attorney, prepare reports that highlight the case progress and any potential issues.

• Ensure compliance with all legal and regulatory requirements in the handling of case files.

5. Collaboration:

• Work closely with their assigned attorney and support team to ensure efficient case processing.

• Assist attorneys in preparing cases to be transferred to litigation when settlement cannot be reached.

• Participate in team meetings to discuss case strategies and share best practices.

Experience and Qualifications:

• Education: Associate’s or Bachelor’s degree in legal studies, business, or a related field is preferred.

• Experience: Minimum of 2-3 years of experience in personal injury case management, specifically handling pre-litigation cases.

Skills:

• Strong understanding of personal injury law and pre-litigation processes.

• Excellent communication and negotiation skills.

• Proficiency in case management software, particularly Filevine or similar platforms.

• Ability to manage multiple cases efficiently and effectively.

• Strong organizational skills with a keen attention to detail.

• Ability to work independently and as part of a team.

• Bilingual (preferred)

Licenses/Certifications : Paralegal certification is a plus but not required.
