JOB SUMMARY:Under the supervision of the County Attorney, the Assistant Attorney II is an exempt position under FLSA. The primary goal of this position is to prosecute violations against state and local laws. As the Assistant Attorney I, this position is responsible for working with the Sheriff’s department and other law enforcement agencies to determine whether there is adequate evidence to file charges against individuals and secondly working successfully to bring those cases to successful closure in protecting the public safety, health, welfare and interest. This employee must exercise considerable independent judgment. Information handled in this office is of a confidential nature. Supervises staff in the preparation of documents and papers.ESSENTIAL FUNCTIONS:Prepare and prosecute juvenile offender, Care and Treatment, Child in Need of Care, Traffic, and Criminal cases, both misdemeanor, and felony;Prepares and files journal entries, legal documents, letters, invoices, reports, and records, summonses, complaints, motions, and subpoenas;Prepare motions to continue, motions to revoke probation, motions to resume prosecution, motions to release and/or destroy property;Prepare subpoenas and court notices for witnesses and victims in cases;Prepare briefs and other motion for the Kansas Supreme Court and Kansas Court of Appeals;Appear before the District Court on arraignments, evidentiary hearings, preliminary hearings, termination hearings, bench trials and jury trials;Determines whether adequate evidence exists to prosecute cases for violation of state and local statutes;Study and analyze writs, pleadings, exhibits, case files and records in order to ascertain the issues before the court and appropriate legal precedent;Coordinates schedule with the court calendar when setting hearing dates and times;Codes, prepares, disposes, and oversees the management of all case files, and office files;Prepares various reports for the County and for the State;Reviews law journals and other legal publications to identify court decisions pertinent to pending cases;Conducts legal research;Prepare and organize case files;Make telephone or other contact with witnesses and/or victims to ensure they have been notified of court hearings and are planning on attending;Interview and advise complainants and witnesses;Other duties as assigned.SECONDARY FUNCTIONS:Performs other related duties as required.SUPERVISORY FUNCTIONS:None.MINIMUM QUALIFICATIONS:To perform this job successfully, an individual must be able to perform each essential function satisfactorily.
