Work involves planning and organizing work, examining, and preparing legal documents, providing legal advice and opinions, participating in administrative hearings, and interpreting laws and regulations. Collaborates with staff subject-matter experts to research and draft rules; analyze statutes and legislative bills; and prepare orders, memoranda, briefs, pleadings, and other documents. Works under limited supervision, with considerable latitude for the use of initiative and independent judgment.This position:Researches and analyzes state and federal laws and regulations, orders, pleadings, and other documents.Provides legal support and advice to client program areas and interacts with outside counsel on interpretation and application of state and federal laws and regulations.Directs, organizes, and coordinates legal and administrative activities.Attends, participates, presents, and leads in both virtual and in-person meetings with staff and external stakeholders.Coordinates, advises, and drafts legal opinions, memoranda, briefs, contracts, pleadings, and reports.Briefs executive management and the commissioner on legal issues.Plans and presents internal training to staff and attorneys.Reviews legislation, drafts bills, and advises and works on agency implementation projects.Coordinates case preparation for court hearings and represents the agency in hearings. Assists the Attorney General’s office in preparing insurance company receivership cases for litigation. May assist in analysis of evidence and the development and assembly of evidence for pleadings.Works with industry stakeholders and program staff on complex high value mergers, acquisitions, and other transactions.Works closely with program staff on insolvent and financially stressed companies. Includes assisting staff with statutory supervision and conservation of troubled companies.Assists agency staff with analyzing filings to determine if licensure or investment plans are appropriate and comply with statute and rules.Works on and may be lead attorney on complex insurance company receiverships, advising agency leadership, appointed special deputy receivers (SDR), and program staff. Cases may entail the identification of insolvency, development of the case and receivership pleadings and other filings, selection and appointment of SDRs, SDR take-over of the company, asset recovery actions, identification of tax and other liabilities of the estate, assistance with overseeing claims payments, interaction with guaranty funds, and eventually winding down of the receivership. Researches and analyzes a variety of diverse legal issues and strategies involved with receiverships. May direct program staff and SDRs with proper course of action.Performs other duties as assigned.This position requires:Graduation from an accredited law school with a Juris Doctor (J.D.) or comparable advanced legal degree.Must be licensed as an attorney to practice law in the State of Texas.Member in good standing with the State Bar of Texas.Three years of legal experience. Litigation, administrative, regulatory, or insurance law experience or finance and accounting background preferred.Drafting legal opinions, memoranda, briefs, and other legal documents.Managing caseload with variety of legal issues requiring prioritization, decision making, and collaboration with client(s).Note | substitution language:Law clerk experience can be counted toward the legal experience.Additional job details:This position requires regular work attendance.
