Minimum Qualifications

Admission to the New York State Bar and a member in good standing with at least six years post law school legal experience as a practicing attorney in litigation and/or in administrative proceedings. Applicants must have prior supervisory experience and be capable of managing a legal office of attorneys and support staff. Due to the nature of the work in this position, a background in Labor Relations is essential.Duties Description

Under the direction of the General Counsel and/or Deputy Counsel, the Associate Counsel provides high-level support and legal advice to the Medicaid Inspector General, Executive staff and agency division management. The incumbent works closely with the Bureau of Human Resources Management and specifically its personnel, employee relations and diversity management staff to address employment related matters. The Associate Counsel oversees complex litigation and administrative hearing cases involving Medicaid and labor and employment matters, may handle referrals from oversight agencies such as the State Inspector General, and may also supervise attorneys and legal assistants. Travel is required as part of this position. Duties include, but are not limited to:Manage, and participate in, all aspects of litigation and/or administrative hearings, from commencement to post-trial or hearing resolution, including negotiating settlement agreements.Prepare and present cases at the Division of Human Rights and EEOC; conduct Civil Service Law Section 72 hearings and disciplinary arbitrations; handle Workers’ Compensation or Unemployment matters; and PERB proceedings.Identify and articulate critical issues and formulate a legal strategy.Review and respond timely to pleadings; draft affidavits, memoranda of law and other litigation related papers; negotiate, draft, and/or review stipulations of settlement.Apply State and federal court rules in civil litigation and engage in discovery including eDiscovery.Prepare witnesses and present evidence in defense of OMIG’s Medicaid program integrity and related activities.Assist the Office of the Attorney General in all aspects of litigation involving the OMIG.Provide analysis and interpretation of employment discrimination and labor laws such as the Taylor Law, the Civil Rights Act, Americans with Disabilities Act, Human Rights Law.Advise and/or provide input and legal expertise on the agency’s human resources and employee relations program and initiatives.Conduct legal research, analyze and interpret laws, rules, and regulations; draft regulations and legislation.Demonstrate a working knowledge of health law, Medicaid issues, and/or labor and employment matters including but not limited to public sector unions.Collaborate with partner agencies and law enforcement entities.Review agency programs and provide proposals and recommendations.Supervise Staff and Manage the Day-to-Day Operations of Office of Counsel Staff and Participate as a Member of the OC Management Team

Implement state, agency, and OC policies and procedures such as time and attendance, use of electronic resources, and equal opportunity rights.
