Primary PurposePrimary Purpose of Organizational Unit:This position performs legal work advising the Haywood County Health and Human Services Agency concerning legal matters, and representing the Haywood County Health & Human Services in court when necessary. This employee serves in a leadership capacity on committees. The employee in this position performs a variety of professional legal work for the Health & Human Services Agency which includes the following divisions: Social Work, Economic Services, and Public Health. The work involves preparing cases associated with the Health & Human Services Agency for trial and presenting these cases in court. Additional responsibilities include drafting court orders, preparing legal documents, participating in required pretrial conferences, consultation and training to staff. Workflow for this position will be directed by the Agency Attorney II.

Primary Purpose of Position:Prepares cases for trial, which includes performing research, interviewing witnesses and talking with experts; and presents cases in court on behalf of the Haywood County Health & Human Services Agency (Social Work, Economic Services, and Public Health). Provides legal advice and consultation to employees and staff of the Health and Human Services Agency and related agencies concerning legal problems that may arise during the course and scope of the duties of said personnel. Provides training to staff regarding court process/procedures. Participates in required pretrial conferences. Prepares legal documents such as petitions, motions, etc., and drafts court orders. Drafts contracts, ordinances and resolutions as requested by the Agency Director.

Additional Job Functions:Performs related work as directed by the Agency Director, including providing legal counsel to all program areas as needed.

General Statute 108A-18:a.) The special county attorney shall have the following duties and responsibilities:To serve as legal advisor to the Agency Director, the Health and Human Services Board, and the Board of County Commissioners on Health and Human Services matters.To represent the county, the plaintiff, or under oblige in all proceedings brought under Chapter 52A, the Uniform Reciprocal Enforcement of Support Act and to exercise continuous supervision of compliance with any order entered in any proceeding under the act.To represent the Haywood County Health and Human Services Board in appeal proceedings and in any litigation relating to appeals.To assist the district attorney with the preparation and prosecution of criminal cases under Article 40 of Chapter 14, entitled "Protection of the Family".To assist the district attorney with the preparation and prosecution of proceedings authorized by Chapter 49, entitled "Bastardy".To perform such other duties as may be assigned to him/her by the Board of County Commissioners, the Haywood County Health & Human Services Board, or the Agency Director.

Work Schedule:The attorney will follow the agency schedule for regular business hours from 8-5 five days per week. However, flexibility will be required based upon the schedule established by the Court system.

Change in Responsibilities or Organizational Relationship:The Attorney will be an employee of the Haywood County Health & Human Services Agency under the supervision of the Agency Director.

Qualifications:Graduation from a recognized school of law.

License or Certification Required by Statute or Regulation:Possession of a license to practice law in the State of North Carolina.

Knowledge, Skills and Abilities:Special Requirements - Considerable knowledge of case, statutory, regulatory, and common law. Considerable knowledge of judicial and quasi-judicial procedures and the rules of evidence. Ability to conduct civil or criminal litigation. Ability to interpret and apply constitutional provisions, statutes, administrative regulations, court decisions, and other precedents. Ability to analyze facts, evidence, and legal instruments. Ability to express conclusions and arguments clearly and logically in oral and written form. Ability to maintain effective working relationships.

Physical Requirements:Position requires mostly sedentary work that will occasionally require walking or standing for brief periods of time. Requires exerting up to 10 pounds of force on a recurring basis as well as routine keyboard operations. The job requires normal visual acuity and field of vision, hearing and speaking ability. The position risks no exposure to environmental hazards.

Physical Effort:Great physical effort is not necessarily a part of the job, but long hours to attend evening meetings or to work on agency related matters may be required. Occasional travel out of town may also be necessary. Stamina is required to endure and resolve crisis oriented work situations.

ADDITIONAL REQUIREMENTS FOR POSITION:Applicants must submit official college transcripts (if applicable). Applicants must have NC Driver's License and access to a vehicle. The applicant must have a clean driving record with no more than three (3) points showing on current DMV record.
