OLS is comprised of five legal teams: the Administrative Litigation team; the Center for Health Care Quality (CHCQ) team; the Public Health Programs (PHP) team; the Regulations, Privacy and Special Projects team; and the COVID Response/Public Records Act (PRA) team. This position is for the CHCQ team.Job Description And Duties

Do you set high standards for yourself and enjoy working on challenging questions of law and policy?CDPH OLS is seeking an Attorney to join a team committed to protecting our State's most vulnerable residents by ensuring, among other things, that long-term care residents receive the treatment and care required by law; that patients admitted to a hospital receive care that complies with the licensing requirements; and that businesses licensed by the Department to provide care in a patient’s home are qualified to provide the care needed.The Attorney will advise and support CDPH’s Center for Health Care Quality (CHCQ) and will work primarily with CHCQ's Field Operations Branch (Field Operations). Field Operations is responsible for ensuring that health care facilities and certain health professionals are licensed, regulated, inspected, and/or certified to legally operate or work in California. The Attorney will work closely with Field Operations staff on a wide variety of issues that may include review of citations for dangerous regulatory violations that occur in licensed skilled nursing facilities, such as untreated bed ulcers and avoidable falls that lead to severe injury or fatality, or administrative penalties against general acute care hospitals for regulatory violations such as sponges and other foreign objects left in patients, medication errors, or a failure to accurately monitor a patient for complications after surgery.The Attorney will provide legal advice on administrative, procedural, and regulatory issues and projects that have significant impact on public health and policy. The Attorney will also (1) advise Field Operations staff on responses to Public Record Act requests and subpoenas, (2) assist the Attorney General’s Office in litigation involving CHCQ, (3) advise on the legal consequences of breaches of medical information and respond to questions related to federal and state privacy laws, (4) assist with the drafting of new statutes and regulations to implement new laws or address gaps in existing laws, and (5) assist with public health emergency planning and response.Finally, the Attorney must be able to function reliably and independently, exercise discretion, work well under great pressure in politically sensitive situations, and complete the work required within strict time requirements.The incumbent works under the direction of the CEA and/or CS ACCs of the CHCQ team within OLS.The attached duty statement indicates whether this position is eligible for telework. All employees who telework are required to be California residents in accordance with Government Code 14200, and may be required to report to a CDPH office, when needed. Candidates who reside outside of the state of California may be interviewed; however, the selected candidate must have a primary residency in the state of California prior to appointment (and continue to maintain California residency) as a condition of employment.
