SUMMARY:

An at-will management/professional position under the general supervision of the Mayor. The City Attorney plans, organizes, directs, and controls the provision of legal services to and for the City; provides legal advice and guidance to the Mayor, City Council, City Administrator, Boards and Commissions and City departments. Prepares legal documents, ordinances, and resolutions for review by city departments and council, litigates on behalf of the city, and assists in labor negotiations. The City Attorney’s Office is strictly prohibited from providing legal advice and/or representation to citizens.ESSENTIAL FUNCTIONS:Stays up to date on legislative changes and works with Department Director to implement into SMC.Provides ongoing legal advice to the elected and appointed officials of the City, the City Administrator, and departments of the City.Resolves legal questions which arise during the development and implementation of City projects and programs.Gives legal opinions and advice as questions are raised at Council and Commission meetings attended.Represents the City in civil actions where the City is a party in state and federal courts and before administrative agencies.Supervises and reviews the preparation of ordinances, regulations, contracts, and other legal documents ensuring compliance with local, state and federal law and adequate legal protection of the City.Coordinates the activities of the city attorney's office with those of other departments to ensure effective action.Represents the City in civil proceedings before local district court, superior court, appellate courts, and before administrative agencies.Directly supervises assigned staff.Engages in the practice of preventive law by interpretation, projection and application of legal trends and provides advice thereon to Council, City Administrator, and city departments.Attends frequent evening staff and community meetings as required, including City Council, Finance & Administration committee meetings, and public hearings.These duties are not inclusive of all duties, and as such, this position may perform other duties as assigned.QUALIFICATIONS:Education and Experience:Graduation from an accredited law school with a Juris Doctorate degree.Member in good standing of the Washington State Bar.Minimum of three years as municipal government attorney.Additional License:A current Washington State Driver’s License with a driving record free of serious or frequent violations.Desired Knowledge, Abilities and Skills:Knowledge of the Revised Code of Washington and the principles of municipal law, including drafting ordinances and resolutions.Excellent knowledge of municipal law, including land use and environmental law, labor and employment, and contracts.Must have excellent analytical and writing skills.Excellent verbal and written communication skills.The position requires a commitment to public service, municipal management, and the ICMA Code of Ethics.Experience demonstrating the ability to make analytical and reasoned judgments on issues of public sensibility.Ability to establish & maintain effective working relationships with Mayor, City Council, City Administrator, Department Heads, fellow employees, the public, City Boards & Commissions.Demonstrated ability to develop a team approach to problem-solving with City staff and Council.Experience of a high level for strategic planning, financial and budgetary processes, capital improvement program management, intergovernmental relations, labor relations/negotiations/contract administration, and land use and traffic and transportation issues.Ability to use a variety of computer software, including word processing and spreadsheets.Ability to work cooperatively and effectively with others.Physical Demands and Work Environment:The physical demands and work environment characteristics described here are representative of those an employee encounters while performing the essential functions of this job. The employee may be required to push, pull, lift and/or carry up to 50 pounds. The noise level in the work environment is usually moderately quiet while in the office or moderately loud in the field. Work may periodically require the employee to climb, balance, bend stoop, kneel, crouch, and/or crawl. However, some local travel is involved in public relations activities, attending meetings, and visiting city departments and facilities. Exposure to adverse weather conditions is minimal.
