Magistrates are attorneys at law admitted to practice in Ohio. By order of reference from the judges of Cleveland Municipal Court, magistrates are assigned to hear civil, criminal and traffic matters and issue magistrate decisions, pursuant to Civil Rule 53, Criminal Rule 19, and Traffic Rule 14, subject to approval by the judges.ESSENTIAL DUTIES AND RESPONSIBILITIESMagistrates are required to perform legal research and preside over the following dockets and issue decisions based on the facts presented and the applicable law:Small ClaimsTraffic ArraignmentMisdemeanor ArraignmentPre- and Post-Judgment MotionsBond Forfeiture HearingsGarnishment HearingsOhio Bureau of Motor Vehicles Appeals and Petitions for Limited Driving PrivilegesParking Violation Bureau AppealsMunicipal Income Tax ArraignmentsCognovit NotesDefault JudgmentsCivil and Criminal Motions, Pre-trials and TrialsProvide quality service that continuously improves, that meets or exceeds public expectations, and ensures all are treated with courtesy, dignity, and respect.The above statements are intended to describe the general nature and level of work being performed by individuals assigned this classification. Other duties may be assigned and work may be performed outside of normal business hours.KNOWLEDGE, QUALIFICATIONS, SKILLS and ABILITIESGood interpersonal, written and verbal communication skillsAbility to organize and prioritize dutiesHighly organized work habitsSolid computer skillsDemonstrated ability to conduct legal researchMust have or develop an understanding of Court operations in order to assess needs and provide appropriate support.EDUCATION and/or EXPERIENCEAttorney and member of the Ohio Bar in good standing; five (5) years legal experience, with two (2) years trial experience or the equivalent thereof; basic mediation skills or the equivalent thereof; working knowledge of Ohio Rules of Civil and Criminal Procedure, Ohio Traffic Rules, Ohio Rules of Evidence and Cleveland Municipal Court Rules of Practice and Procedure.PHYSICAL DEMANDSThe physical demands described here are representative of those that must be met by an employee to successfully perform the essential functions of this job. In addition, while carrying out the duties of this position, the employee is expected to model high ethical conduct on and off the job, and exhibit a professional and respectful demeanor with all Court employees.Qualified applicants may be required to submit to testing and provide writing samples. Proof of education and employment references will be required before final interview. Employment predicated upon successful completion of criminal record check and drug testing required.
