A Day in the LifeLitigation and Investigations Counsel (“Counsel”) will serve on Medtronic’s corporate Litigation and Investigations team and will focus on developing and implementing strategy to drive successful outcomes for the enterprise, with particular focus on government-related litigation and investigations, as well as internal investigations.Counsel will be responsible for managing litigation and investigations to achieve strategic objectives within budget; hiring, supervising and working closely with outside counsel; providing oversight to in-house paralegals; engaging in and driving early evaluation and resolution of claims; and providing legal advice and counsel to business clients on issues related to risk assessment, regulatory compliance and litigation risk avoidance. This position will report to a management-level litigation attorney.Counsel will advise clients, direct investigations and manage risk arising from various regulatory regimes applicable to the global medical technology industry, including but not limited to global anticorruption laws, the U.S. Anti-Kickback Statute, the Stark Law, the False Claims Act, antitrust and competition laws and consumer protection laws. Counsel will provide legal advice to help mitigate risks and maintain compliance while providing legal support to Medtronic’s Operating Units and Regions. Counsel will manage litigation with or relating to government entities, including under the False Claims Act. Counsel will also serve as a company liaison with federal, state and local law enforcement and provide legal advice to the Global Security, Internal Audit and Global Compliance organizations. This individual must possess strong legal and communication skills and the ability to interact effectively with a variety of individuals in cross-functional roles in the organization. This role requires a high level of professionalism and responsiveness to business stakeholders in a large, dynamic and fast-paced environment.Location: Minneapolis-St. Paul, Minnesota or Washington, DC preferable but open to another location with a significant Medtronic office facility, such as Boulder, CO, Northridge, Santa Rosa, or Irvine, CA, or Boston, MA.Responsibilities may include the following and other duties may be assigned.Evaluate and supervise litigation and investigations involving various Medtronic operating unitsDirect privileged risk assessments, internal investigations or reviews involving litigation, compliance or regulatory issuesHire, supervise and manage outside counselDevelop, manage and meet budgets for efficient and effective management of casesAchieve resolution of litigation and investigations on favorable termsProvide day-to-day work direction and feedback to paralegal and administrative support personnelConsult and collaborate with company strategic business counsel on issues relating to litigation strategy, exposure and riskMINIMUM REQUIREMENTS:Juris Doctor from nationally recognized law schoolLicensed to practice law and in good standing under the Bar of at least one state8+ years of complex litigation/investigations experienceNICE TO HAVE:A diverse background and set of experiencesGovernment prosecution and/or defense experienceIntegrity and strong ethical centerComplex litigation experienceExperience conducting witness interviewsExperience participating in depositions, mediations, and court proceedings, including trialsExperience managing collection and production of documents and electronic records in response to legal processExperience with direct client contact providing litigation and risk management adviceExcellent written and verbal communication skillsAbility to work collaboratively and communicate across a complex organizationAbility to establish credibility and develop strong working relationships with clientsCapable of inspiring trust and confidence of clients, including senior managementAbility to work on multiple projects at the same timeProven ability to litigate as part of a large, multidisciplinary teamStrong experience and skill with management of e-data and e-discovery issuesSuperior common sense and judgmentExceptional advocacy and negotiating skillsAnalytical risk identification, evaluation and management skillsFlexibility, adaptability, responsiveness and collegialityExperience managing or directing or serving as outside counselMedical or scientific background or knowledgePhysical Job RequirementsThe above statements are intended to describe the general nature and level of work being performed by employees assigned to this position, but they are not an exhaustive list of all the required responsibilities and skills of this position.The physical demands described within the Responsibilities section of this job description are representative of those that must be met by an employee to successfully perform the essential functions of this job. PR) locations (USD): $190,400.00 - $285,600.00This position is eligible for a short-term incentive called the Medtronic Incentive Plan (MIP).
