The Role:

The Senior Privacy Counsel, North America, will provide strategic legal advice and manage our privacy program for our operations in the US and Canada, implementing best practices and solutions to reduce privacy and security risks and protect our employees' and customers' personal data.

This position will also support the global legal team by structuring, drafting, and negotiating technology-related and other agreements.

Responsibilities:

Acting as the primary point of contact for privacy matters

for North America.

Becoming a trusted, business-minded strategic advisor to the internal teams in support of new products, services, and initiatives, often involving novel technologies and innovative marketing campaigns.

Supporting the expansion and evolution of the current global privacy program in North America, including developing and maintaining localized data protection and privacy risk management framework

Ensuring compliance with (and performing gap analyses for) applicable data privacy and protection laws in North America with a focus on PIPEDA, CCPA, CPRA, PIPA, CASL, the FTC Act, State-level privacy and security laws, and other US federal laws that govern the collection of information online, including sector-specific requirements in financial services, biometrics, and digital advertising

Providing data protection/ privacy guidance on a wide range of projects for current and future North America jurisdictions; assisting with policy drafting and implementation, privacy by design processes, data mapping, and inventories; completing PIAs and DPIAs; and designing and meeting KPIs

Drafting and revising privacy notices, terms of services, incident response plans, and data breach regulatory notifications

Completing audits and validating that core data privacy control policies and processes are operating effectively, including maintenance of data inventories and records of processing of PII data registers

Supporting the management of consumers rights requests and other day-to-day privacy-related claims

Assisting with creation and delivery of our data protection and security training programs

Supporting our global Legal function in structuring, drafting, and negotiating privacy-related, technology-related, and other commercial contracts, including professional services agreements, vendor/service provider agreements, US-specific privacy and security agreements, and cross-border transfer agreements.

Qualifications:

Admission to practice law in a US State with excellent academic credentials

Minimum of 5 years' experience specializing in providing legal advice on data privacy/protection matters

Certified Information Privacy Professional/United States (CIPP/US) strongly preferred, and CIPP/E desired

Comprehensive knowledge of and practical experience with US privacy framework, specifically CCPA/CPRA, CAN-SPAM, specific state data privacy and security laws, US Federal privacy legislations, and other international legislations including PIPEDA and CASL

Robust understanding of core elements of data protection and regulation in North America and how it impacts business functions

Good knowledge of the GDPR

Experience in online technologies required

Experience in online gaming or e-commerce desirable but not mandatory

Substantial experience in a similar privacy-related role is required

Strong knowledge of US and Canadian data protection laws framework is required

Creative, business-minded problem solver who works collaboratively with other functions and leaders

Excellent communication skills, both written and verbal

Ability to act independently and exercise good judgment

Target Salary Range:

$124,250- $155,500 Annual Salary
