Demant has a strong presence in the US market and is looking for outstanding passionate talent committed to the goals and mission of the company.We are seeking an experienced and highly skilled senior-level attorney with 10+ years of experience to join our in-house legal team. The ideal candidate will have extensive experience and knowledge in healthcare law and transactions, particularly concerning device manufacturers and their customers, healthcare clinics, managed care and health insurance plans, Medicare and Medicaid, and federal and state healthcare regulations. The ideal candidate will also possess a deep understanding of fraud and abuse laws, reimbursement statutes, and various other regulatory frameworks pertinent to the healthcare industry. This role requires the candidate to provide practical, timely and proactive advice to senior management and the ability to manage complex transactions. The new hire will be part of a successful legal team, reporting to the Head of Legal, US.Responsibilities

Healthcare Regulatory and Transactions:

Advise on legal matters related to device manufacturers, healthcare clinics, managed care plans, and Medicare and Medicaid.Provide counsel on complex federal and state healthcare regulatory issues.

Fraud and Abuse, Reimbursement Statutes:

Maintain comprehensive knowledge of:Manufacturer and provider licensing requirementsRelevant statutory schemas (e.g., Anti-Kickback Statute, Stark Law, False Claims Act (FCA), Health Insurance Portability and Accountability Act (HIPAA), Sunshine Act)Relevant regulatory schemas (e.g., federal reimbursement guidelines, FDA rules, CMS requirements, professional board regulations)Consumer protection lawsProvide practical guidance and innovative solutions for compliance with the Anti-Kickback Statute and other fraud, waste, and abuse statutes.

Contract Drafting and Evaluation:

Draft and evaluate agreements involving hospitals, physicians, and other healthcare providers, including but not limited to:Professional services agreementsClinical research agreementsHealthcare payor agreements and participating provider agreementsDelegated credentialing agreementsProcurement agreementsBusiness associate agreementsRebate agreements

Compliance and Marketing:

Provide guidance on marketing materials for compliance with the Anti-Kickback Statute and state consumer protection laws.Support compliance investigations and audits.

Mergers and Acquisitions:

Conduct due diligence from a healthcare regulatory perspective for mergers and acquisitions.

Third Party Administrators:

Work with Third Party Administrators and ensure compliance with CMS requirements regulating downstream entities.

HIPAA Compliance:

Offer day-to-day guidance on HIPAA compliance questions.

Other Legal Guidance:

Provide guidance on various other legal topics including:Interaction with law enforcementResponding to subpoenasDisclosure of medical informationGuardianshipInformed consentReporting suspected abuse

Policy and Procedure Development:

Assist in developing and updating company policies and procedures to ensure legal compliance and mitigate potential disputes.Conduct training sessions for employees on relevant legal topics.

Collaboration and Communication:

Collaborate with cross-functional teams, including HR, IT, and Compliance, to address legal issues and support business initiatives.Communicate effectively with internal and external stakeholders, providing clear and concise legal advice and updates on compliance transaction matters.Provide other legal advice and counsel as needed.Assume responsibility for other legal projects as needed.

Qualifications

Juris Doctor (JD) degree from an accredited law school.Active bar membership in good standing.A minimum of 10 years of experience in healthcare regulatory and transaction law.Proven expertise in the areas outlined above.Excellent analytical, drafting, and negotiation skills.Strong interpersonal and communication skills.Ability to provide practical and business-oriented legal advice.The successful candidate will have a keen ability to provide practical advice and weigh legal risk against business needs and realities.Strong organizational skills with the ability to manage multiple priorities and deadlines.Demonstrated ability to work independently and as part of a team in a fast-paced environment.Must make decisions based on sound judgment and display the highest level of ethical conduct and integrity.Note:
