DescriptionPOSITION SUMMARY:The job duties of the Assistant Corporation Counsel include performing duties required under Wisconsin Statute § 59.42, as directed by the Corporation Counsel. These duties include representing and advising County officials and employees in civil matters; representing the public interest in human service-related cases and representing the Health and Human Services Department; responding to legal inquiries, rendering legal assistance and opinions, litigating cases, drafting policies, procedures, ordinances, contracts, and legal documents, maintaining records and files, and preparing reports.ESSENTIAL FUNCTIONS:The following duties are normal for this position. These are not to be construed as exclusive or all-inclusive. To perform this job successfully, an individual must be able to perform each duty satisfactorily. Other duties may be required and assigned.Conducts legal research and drafts written legal opinions. Drafts, reviews, and researches county resolutions, ordinances, contracts, and legal documents.Provides legal counsel and opinions to County departments and County Board committees.Updates County departments on changes in laws or regulations and the impact to the department.Advises and represents the Child Support Agency in child support and paternity cases.Advises and represents the Health and Human Services Department in guardianship and protective placement proceedings, and termination of parental rights proceedings.Represents the interests of the public in children in need of protection or services proceedings.Advises and represents the Health and Human Services Department in termination of parental rights proceedings.Represents the interests of the public in mental health, alcohol, and drug dependency commitment proceedings.Advises and represents the Community Development Department on land use matters.Advises the Economic Support Division of the Health and Human Services Department regarding Medicaid eligibility and divestment issues.Advises and represents Human Resources on employee relations or labor relations matters in the absence of the Corporation Counsel.Performs legal research and drafts briefs for court.Analyzes cases and recommends disposition; negotiates agreements; advises staff, drafts legal documents and pleadings including complaints, discovery documents, and pretrial motions.Attends hearings; prepares witnesses; handles jury selection; negotiates settlements.Creates, reviews, or edits contracts in which the County is a party.Reviews claims, suits, and demands. Coordinates discovery with county departments, develops litigation strategy, and analyzes settlement proposals.Prosecutes ordinance violations.Other duties as assigned.KNOWLEDGE, SKILLS AND ABILITIESKnowledge, skill, and ability to understand and use legal terminology, legal format, and processes.Knowledge of standard and legal office practices, procedures, and techniques.Knowledge of Wisconsin Statutes and ongoing statutory changes, procedural changes, and form changes.Skill to take notes and accurately incorporate essential details in preparing legal documents.Ability and skill to prepare Court documents in a timely and accurate manner.Ability to perform detailed work accurately and independently in compliance with stringent time limits with minimal direction and supervision.Ability to prioritize duties to accomplish a high volume of work product while adapting to constant changes in priority.Ability to maintain accurate and legible notes.Ability to read and accurately interpret statutory language regarding administrative details of the legal process.Knowledge of County policies, procedures, and practices.Knowledge of local government organization and its departmental operating requirements.Ability to establish and maintain effective working relationships with other local and statewide legal system agencies, law enforcement agencies, interdepartmental office personnel, media, other employees, attorneys, victims, witnesses, family members, and the general public.Considerable knowledge of modern office practices and procedures, including e-filing.Ability to analyze and prepare organizational and functional reports from research data.General knowledge of standard office procedures, practices, equipment, and office assistance techniques.Knowledge of the use of a multi-line telephone system.Ability to type accurately at a reasonable rate of speed.Ability to operate standard office equipment and perform word processing and/or data entry.General knowledge of current office practices and procedures and knowledge of the operation of standard office equipment and software.Ability to work the allocated hours of the position.LANGUAGE SKILLSAbility to explain relevant information effectively to various parties.Ability to communicate effectively with other members of the staff, supervisor, and the public.Ability to communicate clearly and concisely in both written and verbal form.Must be proficient in workplace English and spelling.Ability to read County policies and procedures; written instructions, general correspondence; SDS sheets, safety manuals, maps, etc.MATHEMATICAL SKILLSAbility to perform mathematical calculations.REASONING ABILITYAbility to understand and effectively carry out verbal and written instructions.Ability to develop, interpret, and implement local policies and procedures; written instructions, general correspondence; Federal, State, and local regulations.Ability to define problems and deal with a variety of situations.Ability to think quickly, maintain self-control, and adapt to stressful situations.Ability to maintain discretion regarding business-related files, reports, and conversations, within the provision of open records law and other applicable State and Federal Statutes and Regulations.Organizational and time management skills needed to meet deadlines.Ability to work accurately with attention to detail.Ability to maintain confidentiality.Ability to prepare and maintain accurate and concise records and reports.Ability to analyze facts and to exercise sound judgment in arriving at conclusions.Ability to define problems and deal with a variety of situations.Ability to use good judgment and effectively solve problems.PHYSICAL AND WORK ENVIRONMENT:The physical and work environment characteristics described in this description are representative of those an employee encounters while performing the essential functions of this job.
