Business Litigation Attorney – Construction
Our client, a highly regarded national law firm, is seeking an experienced business litigation attorney to join their business litigation team. The ideal candidate should have 5-10 years of business litigation experience and a desire to build their practice around construction litigation. This role will work primarily with architects and engineers on construction litigation matters. Those with business litigation experience and an interest, but without experience, in construction litigation are encouraged to apply.
This role may be based in Kansas City or St. Louis, and the firm offers a hybrid work environment to its attorneys.
Responsibilities:
Reviewing, drafting, and negotiating construction-related contracts, such as design agreements, consultant agreements, and construction contracts, to ensure they protect the interests of architects and engineers.
Representing architects and engineers in disputes related to construction defects, professional negligence claims, breach of contract, payment disputes, and other litigation matters. This includes managing all phases of litigation, from pleadings and discovery to trial and appeal.
Providing legal advice on risk management, project planning, and compliance with local, state, and federal laws, including building codes and regulations relevant to architectural and engineering work.
Analyzing claims against architects and engineers, including evaluating the merits of the claims, gathering and reviewing project documentation, and developing defense strategies.
Advising on insurance coverage issues, including professional liability insurance, and assisting with claims related to coverage disputes.
Representing architects and engineers in alternative dispute resolution processes, such as mediation and arbitration, to resolve disputes efficiently without litigation when possible.
Providing ongoing counseling to architects and engineers on legal issues that arise during project execution and conducting training sessions on legal risk management and best practices.
Working closely with other professionals involved in the construction process, such as contractors, subcontractors, and consultants, to address and resolve disputes and legal matters collaboratively.
Qualifications:
Minimum of 5 years of experience working in a business litigation role. Construction litigation experience a plus.
Licensed to practice law in the state of Missouri.
An entrepreneurial and collaborative work ethic.
The desire to build your practice around construction litigation focused on engineers and architects.
