Our Organization and Mission:

The Office represents the State of Florida in state and federal civil and criminal courts, from trial courts to the Supreme Court of the United States.

Position Summary:

This position is in the Office of the Attorney General within the Civil Legal Services-Ethics in Tallahassee, Florida.

Pay:

$95,481.10 Annually

Qualifications:

Admission to the Florida Bar and six (6) years of professional experience in the practice of law, legal research, teaching law or in administrative or judicial hearings.

The required legal experience must be from the practice of law in a state or territory of the United States.

Membership in good standing in another state Bar can substitute for the required admission to the Florida Bar provided that, pursuant to Rule 11-1.10 of the Rules Regulating the Florida Bar, the attorney applies for and obtains admission to the Florida Bar within 12 months of appointment to a position in this class.

The Work You Will Do:

The responsibilities of this position include, but are not limited to the following:

Reviews complaints filed with the Commission on Ethics which are determined legally sufficient to state a violation of the Code of Ethics for Public Officers and Employees and prepares Advocate's Recommendation for each case, which requires analysis of case facts and research of applicable case law and Opinions of the Commission on Ethics, as well as consultation with Commission staff.

The senior assistant attorney general will have greater responsibility for the more sensitive and complex cases, frequently having statewide impact and influencing the policy direction of state government.

These cases frequently involve emergencies regarding matters of great public importance where response time is minimal and demands are great.

Makes oral presentations of recommendations before Commission on Ethics and responds to questions from Commission and arguments of counsel for Respondents.

Prepares cases for public hearing before hearing officer(s) and negotiates stipulated settlement of cases, including preparation of necessary pleadings and documents and investigation of cases, deposing witnesses as necessary.

Conducts prosecution of cases at public hearings in Tallahassee and elsewhere in state, including preparation of findings of fact and exceptions to Recommended Public Report of hearing officer.

Participates in appellate litigation of orders of Commission on Ethics which are appealed to higher courts.

Prepares and files pleadings and prosecutes actions pursuant to s.112.317(2), Fl.S., to collect penalties recommended by Commission on Ethics and imposed by appropriate entity or Officer which are unpaid.

Performs related work as required.
