Position Summary

The Director of Compliance is responsible for ensuring that the company adheres to all regulations and standards for the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF); International Import and Export; and International Traffic in Arms Regulations (ITAR). This role involves developing, implementing, and maintaining compliance programs, policies, and procedures to ensure the company operates within the legal framework set by regulatory agencies. The Director of Compliance will conduct regular audits, training, and risk assessments to prevent violations and will act as the primary liaison with regulatory bodies.

Key Responsibilities

ATF Compliance

ATF Regulatory Compliance:

Ensure the company complies with all ATF regulations, including the Gun Control Act (GCA) and the National Firearms Act (NFA).

Develop and implement compliance programs, policies, and procedures.

Stay up-to-date with changes in ATF regulations and ensure the company adapts accordingly.

Serve as a Responsible Person (RP) on the Federal Firearms License.

Audits and Inspections:

Conduct regular internal audits to ensure compliance with ATF regulations.

Prepare for and manage ATF inspections and audits.

Address and resolve any findings from audits and inspections promptly.

Documentation and Record-Keeping:

Maintain accurate and complete records as required by ATF regulations.

Ensure proper documentation for all firearms transactions, including acquisitions and dispositions.

Oversee the maintenance and storage of required forms, such as ATF Form 4473.

Training and Education:

Develop and conduct training programs for employees on ATF regulations and company compliance policies.

Provide ongoing education and updates to staff regarding changes in regulations and compliance requirements.

Risk Management:

Identify and assess compliance risks related to ATF regulations.

Develop strategies to mitigate identified risks and ensure compliance.

Investigate and respond to compliance violations, ensuring appropriate corrective actions are taken.

Liaison and Communication:

Serve as the primary point of contact with the ATF and other regulatory bodies.

Communicate effectively with internal stakeholders regarding compliance issues and updates.

Prepare and submit required reports to regulatory agencies in a timely manner.

International Import and Export Compliance

Compliance with International Trade Regulations:

Ensure the company adheres to all applicable international import and export regulations, including those set by the Bureau of Industry and Security (BIS) and the U.S. Customs and Border Protection (CBP).

Documentation and Record-Keeping:

Maintain accurate and thorough records of all import and export activities, ensuring compliance with the Export Administration Regulations (EAR) and other relevant laws.

Licensing and Permits:

Oversee the application and renewal of all necessary licenses and permits for international trade. Ensure timely submissions and compliance with license conditions.

Customs Declarations and Tariffs:

Ensure accurate customs declarations and classification of goods, manage tariff codes, and coordinate the payment of duties and taxes.

Audits and Compliance Checks:

Conduct regular audits of import/export activities to identify and rectify any compliance issues. Coordinate with external auditors when required.

Training and Education:

Develop and deliver training programs for staff involved in international trade to ensure they are aware of compliance requirements and best practices.

Risk Management:

Identify potential risks in the import/export process and develop strategies to mitigate these risks, ensuring the company’s international operations remain compliant.

ITAR Compliance

Compliance with ITAR:

Ensure the company’s operations comply with the International Traffic in Arms Regulations (ITAR), including the management of defense-related products and technology.

Manage ITAR registration and licensing as necessary.

Employee Training and Awareness:

Provide specialized ITAR compliance training to employees, particularly those involved in the handling, development, or export of defense-related products and services.

Record-Keeping and Reporting:

Maintain detailed records of all ITAR-controlled activities, including exports, re-exports, and transfers. Ensure timely reporting to the U.S. State Department's Directorate of Defense Trade Controls (DDTC) as required.

Internal Audits and Assessments:

Conduct regular ITAR compliance audits to ensure all aspects of the company’s operations align with ITAR requirements. Address any findings promptly and effectively.

Liaison and Communication:

Serve as the primary point of contact for ITAR-related inquiries and communications with the DDTC and other relevant regulatory bodies.

Qualifications

Bachelor's degree in Criminal Justice, Law, Business Administration, or a related field.

Minimum of 5 years of experience in regulatory compliance, preferably within the firearms industry.

In-depth knowledge of ATF regulations, the Gun Control Act, and the National Firearms Act.

In-depth knowledge of International Import and Export regulations.

In-depth knowledge of ITAR regulations.

Strong analytical and problem-solving skills.

Excellent attention to detail and organizational skills.

Ability to communicate effectively, both verbally and in writing.

Experience with conducting audits and managing inspections.

Ability to work independently and as part of a team.

Proficiency in Microsoft Office Suite and compliance management software.

Must be able to pass a background check and any other screenings required by the ATF.

Preferred Qualifications

Legal background or experience working with regulatory agencies.

Experience with compliance in a manufacturing environment.
