We are seeking a highly motivated and experienced Labor & Employment Attorney to join our legal team. The ideal candidate will be a skilled advocate with a proven track record of defending employers against complex employment-related claims, particularly in California.Responsibilities:Demonstrating a high “HQ” (Hospitality Quotient) consisting of kindness & optimism, intellectual curiosity, work ethic, empathy, self-awareness, and integrity.Aggressive Defense : Provide strategic legal counsel and representation in all phases of employment litigation, including pre-litigation investigation, discovery, motion practice, trial preparation, and appeals.Proactive Legal Counsel : Advise management on a wide range of employment law issues, including wage and hour compliance, discrimination, harassment, wrongful termination, retaliation, and leave of absence laws.Policy Development and Compliance : Draft, review, and update employment policies and procedures to ensure compliance with federal, state, and local laws.Risk Mitigation : Conduct regular risk assessments and implement proactive measures to minimize legal exposure.Training and Education : Develop and deliver training programs to HR and management on employment law topics.Collaboration : Work closely with HR and other business units to provide practical legal advice and support.Qualifications:Experience:
Minimum of 8-10 years of experience practicing employment law, with a strong emphasis on defense work.Education:
Juris Doctor degree from an accredited law school.Certifications:
Admitted to practice law in California.Technical Knowledge:
Deep understanding of California labor laws, including the California Labor Code, Fair Employment and Housing Act (FEHA), and Wage and Hour laws.Skills:Proven ability to handle complex employment litigation matters, including class actions and PAGA claims.Excellent legal research, writing, and oral advocacy skills.Strong attention to detail and ability to manage multiple deadlines.Ability to work independently and as part of a team.Preferred Qualifications:Experience handling investigations of workplace misconduct.Knowledge of federal employment laws, including Title VII, the ADA, and the FMLA.Experience with alternative dispute resolution (ADR) processes.Benefits of Working at Swickard:Career Path:
