OverviewRepresents the Company, its affiliated companies, and client ERISA Funds in all facets of federal court litigation (primarily collection-related). Prepares various documents and reports for Court, Company Management, and Funds’ Trustees. Manages team of two (2) paralegals who work in above areas. Supervises work of local counsel nationally to ensure compliance with Funds’ litigation requirements.
Responsibilities
Draft court documents, including pleadings, briefs, discovery requests, and demand letters
Court appearances and arguments
Meetings and negotiations
Preparation for and examination of parties and witnesses at depositions
Preparation of Trustees’ reports, opinion letters, settlement agreements
Coordination with Company affiliated Companies’ staff
Supervision of local counsel and Funds Staff
Qualifications
Law degree, admitted in New York State and federal courts.
Two or more years' experience as an attorney.
Ability to successfully communicate legal and financial concepts using verbal and written communication skills.
Well-developed analytical and advocacy skills, both written and oral.
Knowledge of the following Helpful:
ERISA, including representation of multi-employer funds and withdrawal liability.
Federal Rules of Civil Procedure, discovery and federal court litigation, NYS Civil Practice Law and Rules.
Collection practices and procedures.
Computer programs including: Westlaw; Court data bases ( ECF, PACER); Lexis/Nexis/Accurint;Dun & Bradstreet; Word; MS Office Suite; Excel.
Ability to manage paralegal staff.
