Interim Advertising and Promotional Counsel

Major, Lindsey & Africa’s Interim Legal Talent group has an immediate need for a/an Interim Advertising & Promotional Materials Counsel to assist a life sciences organization entering Phase III.

Overview

Our client seeks an experienced and skilled attorney to advise on promotional materials to ensure compliance in both the United States and EMEA.

Company: Our client is a well-respected, public life sciences organization focused on novel treatment for edema.

Experience: Eight to ten years of experience acquired in a top law firm and/or life sciences organization providing advice on advertising and promotion and/or serving as a member of the medical legal review committee (MLR)

Location: Lexington, Massachusetts; Hybrid.

Responsibilities Include:

• Advise the Client on FDA and EMEA advertising and promotional regulations, including, but not be limited to, pre-approval promotion, off-label promotion, independent medical education, patient advocacy interactions.
• Advise the Client on issues related to medical and commercial grants and sponsorships, charitable donations, compensating U.S. and international healthcare professionals.
• Serve as part of the Client Medical Legal Review (MLR) Committee.
• Assist with the review, negotiation and, drafting of myriad commercial agreements, including clinical trial agreements (CTAs), confidential disclosure agreements (CDAs), health care professional (HCP) consulting and services agreements, and supply and distribution agreement.

Qualifications Include:

• Eight to ten years of experience acquired in a top law firm and/or life sciences environment advising on advertising and promotional issues.
• Experience serving on a Medical Legal Review (MLR) committee.
• Admission to at least one state bar active and in good standing, ideally Massachusetts
• Experience reviewing, negotiating, and drafting commercial agreements is preferred, but not required.
