Minimum Qualifications Current New York State employee with one year or more of permanent, contingent-permanent, or 55b/c service in a position allocated to a M-1or above and eligible for transfer under Section 52.6 of the Civil Service Law. ORProvisional Pending Exam Minimum Qualifications: If a viable eligible list does not exist, a provisional appointment may be made in accordance with Civil Service Law. In order to be eligible for the NCP, candidates must be in the departmental promotion field and have one year or more in a permanent or contingent-permanent competitive, or 55b/c service in an Human Resources Specialist 3 (Labor Relations) and must not have failed, or failed to take the last holding of the promotion examination for the title listed above.
Duties Description The Associate Director of Human Resources 2 (Labor Relations) will report to the Human Resources Director and is responsible for the implementation and oversight of the agency’s Labor Relations program and office. Candidates applying for this position should possess:•Experience in a large, proactive, strategic human resources organization. •In-depth knowledge of bargaining unit agreements, labor relations best practices and principles, and Civil Service rules. •Exceptional interpersonal, coaching, listening and communications skills.•Proven ability to remain objective, discrete and exercise excellent judgment. •Ability to develop strong, trusting relationships within the Division and organization.•Strong public speaking and presentation skills.Duties include, but are not limited to:•Oversee the agency’s employee discipline program. Investigate allegations of employee misconduct, issue disciplinary charges, execute settlements and represent the agency at expedited and full arbitration proceedings, ensuring compliance with bargaining unit agreements and Section 75 of the Civil Service Law.•Oversee the agency’s employee grievance program, ensuring proper processing consistent with bargaining unit agreements. Assist program managers in addressing grievances at Step 1, prepare agency level responses to grievances, liaison with OER for grievances appealed to Steps 3 and 4 of the process.•Provide technical assistance and advice to agency management in implementing negotiated contracts and maintaining effective labor relations. Troubleshoot employee issues and advise managers on corrective actions, including the counseling mechanism.•Perform or assist with Section 72 hearings, as required.•Provide summaries and recommendations to the HR Director, Agency Executives, on investigations, disciplinary and grievance matters, and assist with special projects as needed.•Develop, draft, review and implement work rules and policies, ensuring consistency throughout the agency. Communicate with agency legal staff, employee organizations and OER, as necessary.•Liaison with agency’s legal team and OER on allegations of improper practice and discrimination (ADID) and ensure appropriate preparation/action.•Serve as agency representative on local and state-wide labor/management and health & safety labor management committees and work groups. Ensure timely and proper follow up and response to labor/management topics and issues. •Collaborate with and assist Personnel Unit staff on performance management activities, evaluation appeals, employee reassignments, and various other issues.*Travel may be required
Additional Comments NOTE: Support of operations during times of emergency and disaster from State Emergency Operations Center (EOC), state field offices and/or local deployments may be required, which would result in a change and/or increase in working hours, locations and/or duties.NOTE ON TELECOMMUTING: Employees are required to apply and obtain approval through management to telecommute according to the agency’s Telecommuting Program Guidelines.
