General Job Function:
Commercial Operations lead supporting AP1000 new plant, Advanced Reactor (AP300) and Energy Storage product lines within Energy Systems BU.
Develop and negotiate new contracts, lead commercial development of new plant offers, develop MOUs, teaming agreements and NDAs. This includes establishment of, but is not limited to, Terms and Conditions (working with WEC Legal and outside counsel), costing, pricing, financing, insurance, performance guarantees, warranty, consortium and prime sub-models, global contract development. Lead preparation of governance materials for offers. Work with Project Directors and Vice President of Commercial Operations to engage with potential partners negotiating terms of teaming. Travel to global customer offices and project sites for contract negotiations as needed. Work effectively in a global matrix.
Duties and Responsibilities (in the order of priority):
Develop and effectively negotiate engineering and procurement (EP) contracts for ES/New Nuclear Plant, Advanced Reactor and Energy Storage business segments. Ensure alignment with WEC Legal and other WEC organizations, such as supply chain, for terms and condition flow downs. This role also includes having a full understanding of EPC terms and conducting negotiations with construction partners and customers for contracts.Participate and lead as a key member of the offer team for new plant offers where the opportunity requires the review and development of contract or commercial agreements.Develop, negotiate and obtain internal governance (LOA) on all agreements that support execution of the prime agreements. This may include Non-Disclosure Agreements or Confidential Information Exchange Agreements (NDA/CIEA), Memorandum of Understandings (MOU), Bidder Agreements, Early Works Agreements, Teaming/Consortium Agreements and Shareholder Agreements (SHAs).Act as primary commercial interface to partners and develop contracting models and approaches including consortium agreements.Engage with and support Supply Chain and other internal functional teams as needed in the development of flow down terms to suppliers for agreements.Evaluate competitive tender commercial requirements and prepare a compliance matrix. Support the Offer Development process to ensure offer meets all of the contract requirements of WEC using contract compliance matrix tools. Provide critical commercial inputs to the LOA materials including completion of the CRET form.Draft executive management briefing materials for communication of updates/status of negotiations, agreements, etc.Maintain effective internal, partner and customer relationships through effective and productive communications as required.
Education and Qualifications / Skills and Competencies:
Demonstrated experience in new plant EPC contract development and negotiation. Technical and commercial project management skills.Knowledge of the power industry contracts associated with engineering, operation, maintenance, construction, and supply chain.Broad knowledge of products and all related engineering disciplines; experience with project management, contractual negotiations, interpersonal, persuasive and negotiations skills and related financial management tools.Thorough understanding of contract terms, ability to react to constantly changing situations and develop approaches to respond to situations in a manner favorable to WEC.Must have strong communication and overall commercial contract skills and knowledge.
Education Level (Degree, Area of Study):
Minimum Requirement: B.A. or B.S. degree in Engineering, Business or related discipline required; Experience in terms and conditions for nuclear EP+C contracts is required.
JD degree coupled with business experience and/or engineering degree preferred.
Years of Experience:
Minimum of 15 years of global commercial and contract development experience in progressively more responsible and varied assignments. Previous management/leadership experience preferred.
