Job Summary: The Vice President of Legal Affairs - Privacy and Product
will report to the Chief Legal Officer and be responsible for privacy, product and consumer-protection legal matters for Xponential and its portfolio of brands. The successful candidate will have meaningful privacy and consumer protection law experience either in-house or at a law firm. *Although in-person is preferred, this position is eligible to work fully remotely with occasional travel including to our headquarters in Irvine, California. Responsibilities: Serve as subject matter expert on state and federal privacy and consumer protection laws and regulations, including, e.g., data security, data governance, TCPA, autorenewal, and ADA issues. Coordinate with internal clients to understand objectives, identify legal issues, and take a commercial approach to mitigate risk. Maintain knowledge of, and advise business on, developments in state, federal, and global privacy laws consumer protection laws and regulations, as well as best practices. Manage a data governance program; oversee data mapping project in connection with same. Draft and negotiate technology and privacy agreements. Assist in-house commercial contracts attorney in drafting and negotiating privacy and data terms for agreements with other third-party vendors. Conduct due diligence on third party vendors for compliance with both legal and internal requirements. Coordinate with in-house franchise attorneys to assess privacy compliance and terms in connection with franchisees. Coordinate with Information Technology and other parties in responding to data incidents. Manage legal compliance in connection with consumer facing websites, applications, and databases. Maintain library of consumer terms and conditions, including template membership and similar agreements; ensure nationwide compliance in connection with same. Continuously draft and update external privacy policies and disclosures, and other public-facing notices. Create, maintain, and implement privacy and consumer protection-related policies and processes; conduct training on same as needed. Assist with unrelated legal projects on an as-needed basis. Salary Range:

Qualifications: Juris Doctor Degree Minimum of four (4) years of experience at a law firm and/or corporate legal department advising on privacy and consumer protection matters. Member of at least one U.S. state bar with ability to qualify for California in-house registration. Proof of eligibility to work in the United States. Ability to demonstrate and adhere to the highest standards of ethics and integrity. Substantive experience, knowledge and understanding of legal strategies and principles related to job description; ability to analyze and apply legal principles and precedents to legal issues; ability to perform legal research, evaluate alternatives and make sound recommendations. Excellent research and writing skills; ability to prepare clear, concise and complete legal documents, reports, correspondence and other communications materials on complex legal issues; ability to communicate effectively in English, in both written and oral forms; ability to make effective public presentations. Ability to exercise initiative, independent judgment, and work with discretion. Ability to deal effectively with all business contacts, including government agencies, and to establish and maintain effective working relationships with co-workers, internal clients, and external business partners. Sound judgment and superior decision-making, multi-tasking and problem-solving skills; ability to meet prescribed deadlines. Basic proficiency in MS Word, Excel, PowerPoint and MS Outlook. Excellent verbal and written communication skills. Self-motivated and self-directed and able to work without direct supervision on assigned projects and tasks. Ability to work in a fast-paced environment. Professional appearance and demeanor. Ability to travel as needed.
