Legal Enforcement Attorney II

This position is an Attorney II in the Enforcement Department. The Enforcement Department is one of seven departments in the Legal Services Division of the HHS Office of Chief Counsel. The Enforcement Department provides legal support related to HHS sanctions against facilities, programs, and services, including reviewing and drafting notices, correspondence, and guidance documents; interpreting state and federal laws, regulations, and rules; rendering legal advice and counsel to HHS agency personnel; providing legal representation in contested case proceedings, and overseeing enforcement litigation in district courts.

The position serves as legal counsel for the Health and Human Services Commission and performs moderately complex legal work. Work involves planning and organizing work, interpreting laws and regulations, preparing legal documents, rendering legal advice and counsel, consulting with trial attorneys, conducting hearings, and assisting in preparing cases for administrative hearings. May provide guidance to others. Works under general supervision, with moderate latitude for the use of initiative and independent judgment.

Essential Job Functions

This attorney position provides legal representation, consultation, and support to program areas across the Health and Human Services system. Attorneys are required to: consult with program staff on complex issues of law; research and brief relevant legal issues; review policies, rules, regulations, and forms for compliance with legal standards; manage caseloads; assist and prepare cases for hearing; and represent HHSC at hearings.

Attorneys may be required to independently represent clients at hearings governed by the Administrative Procedures Act from docketing to completion, including: analyzing evidence and preparing case strategies; preparing and serving discovery requests; responding to discovery; preparing and responding to motions; identifying and preparing witnesses; conducting depositions; and representing the agency at hearing.

Knowledge Skills Abilities

Knowledge of legal principles, practices, and proceedings; of state and federal laws, rules, and regulations; and of agency administrative rules and regulations.

Skill in legal research, writing, and analysis; in the use of a computer and applicable software; in using reasoning and logic; in identifying and solving complex problems; in prioritizing workloads; and in using judgment to identify courses of action.

Ability to conduct hearings, to prepare opinions and briefs, to prepare cases for trial, to conduct research, to summarize findings, to interpret and apply laws, to use legal reference materials, to communicate effectively, and to provide guidance to others.

Ability to use computer applications and databases related to essential functions of the job, including computer-assisted legal research, and word processing software.

Registration Or Licensure Requirements

Graduation from an accredited law school with an LLB or JD degree.

Member in good standing with the State Bar of Texas.

Initial Selection Criteria

Experience in legal work. Graduation from an accredited law school with a Juris Doctor (JD) degree.
