The Board of Registration in Medicine (BORIM) under the Massachusetts Department of Public Health (DPH) is seeking an experienced professional to work as a Counsel II in the Division of Law and Policy. The Division of Law and Policy prepares and presents legal advice to the Board regarding adjudicatory, policy, licensing, regulatory, legislative, and policy matters. The Division also represents the Board in administrative licensing proceedings and drafts legal documents and correspondence.

The Counsel II position will be cross-trained and expected to handle matters across the range of Division responsibilities, with a particular emphasis on reviewing and responding to subpoenas and other types of document requests.

Duties and Responsibilities (these are a general summary and not all inclusive):

Review requests for information and subpoenas, preparing agency responses while ensuring compliance with the Public Records Act and other laws.

Compile and prepare materials for Board and Committee meetings, including legal memoranda, draft orders, recommended decisions, and proposed findings.

Provide timely legal advice to Board members and agency staff in complex situations.

Research legal issues assigned by the General Counsel and keep them informed of pending legal issues and their resolutions.

Assist in researching, drafting, and implementing Board regulations, policies, and guidelines.

Assist in improving all aspects of data management, including paper and electronic files.

Take actions on behalf of the Board to implement Board directions.

Review and revise form correspondence as necessary.

Perform legal review of staff documents and actions; participate in Board outreach activities; provide training on laws, regulations, and Board policies.

Attend relevant trainings and keep abreast of legal developments.

Conduct oneself professionally in adherence to Massachusetts Law, Board regulations, and policies, maintaining a courteous and professional demeanor.

Adhere to strict legal and regulatory requirements of confidentiality.

Maintain productive working relationships with Board staff and be responsive to supervision.

Develop and maintain a comprehensive understanding of agency procedures and systems relevant to job duties.

Required Qualifications:

Ability to write concisely and effectively, expressing thoughts clearly.

Skill to research and apply public records law and rules of civil procedure.

Capability to use or learn Microsoft Office and document review platforms.

Competency to identify records responsive to a subpoena and applicable confidentiality laws.

Skill to exercise sound judgment and discretion in handling confidential information.

Ability to maintain accurate records in accordance with established procedures.

Mastery in researching applicable precedent in prior BORIM decisions and relevant Massachusetts case law.

Knowledge of the code of professional responsibility.

Comprehension of the State Administrative Procedure Act and ability to represent a government agency before administrative tribunals.

Ability to make effective oral presentations.

Preferred Qualifications:

Knowledge of the functions of the Board of Registration in Medicine.

Experience with medical and legal research sources.

Familiarity with standards of practice in the medical community.

Access to reliable transportation for occasional job-related travel.

Ability to interact productively with people under stress.

Willingness to work long hours if needed, subject to contractual provisions relating to overtime compensation.

MINIMUM ENTRANCE REQUIREMENTS:

Applicants must have a Juris Doctor (JD) degree, admission to the Massachusetts Bar, and at least three years of full-time, or equivalent part-time, professional experience in the practice of law.

Incumbents may be required to have a current and valid Motor Vehicle Driver's License specific to assignment.
