Job DescriptionDirector for the Office of Inspector General (OIG) Chief Counsel Office of Legal Counsel (OLC): Provides legal advice and guidance to the OIG. Performs highly advanced (senior-level) managerial work. Directs and manages the activities and assignments of attorneys and other legal staff within OLC. Work involves developing policies, advising various program areas within OIG, reviewing and analyzing legislation, and researching and interpreting federal and state statutes, regulations, policies, and other guidance materials. Advises agency management on various legal matters and issues and provides legal opinions and solutions as appropriate. May be responsible for implementing a training program to train division attorneys and assisting with administrative contested case resolutions. Interacts with agency management and potentially, state and federal agencies, elected officials, and legislators.Essential Job Functions(30%)

Provides legal counsel and advice to OIG program areas and upper-level management. Manages and directs OLC staff in the preparation and or review of reports, executive summaries, legal memoranda, and other related documents. Assists Deputy Chief Counsel in ensuring coordination with the Office of Attorney General. Monitors compliance with federal and state law and strategic goals. Provides direction, guidance, and assistance relating to OIG program areas and activities to ensure compliance with strategic goals. Assesses potential risks and identifies areas in need of policy, regulatory, and statutory revisions relating to OIG program areas.(25%)

Hires, manages, and develops staff, and recommends appropriate personnel actions to foster a fair, honest, and equitable work environment. Provides direct reports with work assignments, clear direction and information on responsibilities, and work performance expectations. Develops work performance plans and conducts performance evaluations at least annually. Oversees the development and advancement of subordinates and agency attorneys through training and effective use of employee development plans. Develops, prepares, organizes, and implements training programs to ensure Chief Counsel staff have and receive relevant training to ensure and improve subject matter knowledge and expertise, productivity, organizational awareness and compliance, efficiencies, and other work-related competencies. Disseminates information and management decisions to staff regarding relevant departmental activities. Works within agency constraints to provide staff with tools and information needed to carry out their responsibilities and to succeed in their work. Reviews and approves leave and carries out other expected human resources activities with direct reports.(25%)

Directs, manages, and provides counsel to agency staff on legal issues related to audits, inspections, reviews, and investigations, as well as questions related to administrative enforcement. Directs and oversees research, interpretation, and analysis of laws, court decisions, pending legislation and other sources of information related to legal issues. Provides legal guidance to ensure agency and program compliance with rules and regulations. Researches and anticipates potential legal risks and provides guidance and consultation to agency to mitigate risks.(10%)

May represent the Chief Counsel or Deputy Chief Counsel at business meetings, hearings, legislative sessions, seminars, conferences, panels, workgroups, task forces and committees. Responds to legislative inquiries or other requests for information. Provides leadership, guidance, oversight, and support of OIG legal activities and ensures adherence to the OIG mission, goals, and objectives. May conduct presentations, providing information and testimony to HHS agencies, legislative committees, state and federal agencies, and other groups and organizations regarding the OIG.(5%)

May implement training program for Chief Counsel attorneys regarding negotiation, litigation and handling of overall strategies in handling civil, administrative recoupment, exclusion, termination and other administrative sanction cases for Chief Counsel division.(5%)

Keeps manager informed as required or as necessary.Knowledge Skills AbilitiesKnowledge and expertise in legal principles and practices.Knowledge of local, state, and federal laws and regulations related to health and human services, and the principles and practices of public administration and management.Skill in planning, organizing, and managing legal services.Skill in conducting legal analysis.Skill in interpreting and applying statutes and regulations.Skill in establishing and maintaining effective working relationships.Skill in handling multiple projects and meeting tight deadlines.Skill in communicating orally and in writing.Skill in planning and assigning the work of self and others.Skill in legal writing.Ability to direct and organize program activities; to establish program goals and objectives that support the strategic plan; to identify problems, evaluate alternatives, and implement effective solutions; to develop and evaluate policies and procedures; to prepare reports; to communicate effectively; and to plan, assign, and supervise the work of others.Ability to utilize legal experience and training to assist in developing policies and procedures.Ability to conduct legal research, to summarize findings, and to use legal reference materials.Ability to articulate legal concepts to other staff and the public.Ability to recognize and analyze legal issues.Ability to exercise good judgment in appraising situations and to make sound decisions.Registration Or Licensure RequirementsLicensed in good standing with the State Bar of Texas.RequiredBachelor’s degree from an accredited college or university.Juris doctorate degree from an accredited law school.Fifteen (15) years as a licensed attorney.Five (5) years of experience representing or working at a Texas state agency.PreferredFive (5) years of experience supervising or overseeing attorneys, investigators, or auditors.Five (5) years of experience with Texas state contracting and procurement law, rules, and procedures.Texas Board Certified in Administrative Law.Experience in planning and developing investigations and/or prosecutions.Extensive experience in performing legal research and analysis and drafting legal opinions, briefs, pleadings or other legal memoranda.Experience developing policies and procedures.Experience reviewing and approving agency budgets.Experience with the Texas legislative process, including reviewing proposed legislation, drafting fiscal notes, bill analyses, and legislative appropriation requests.Experience with receiving and responding to requests made under the Texas Public Information Act.Experience in implementing a training program for attorneys and legal staff.Experience in compliance with federal grant requirements.Familiarity with fraud, waste, and abuse audits and/or investigations.Additional InformationThe OIG is responsible for preventing, detecting, auditing, inspecting, reviewing, and investigating fraud, waste, and abuse in the provision of HHS in Medicaid and other HHS programs. Potential employees of OIG are subject to criminal background checks in accordance with the HHS Human Resources policy. Any employment offer is contingent upon available budgeted funds.
