Who We Are And What We Do

Under general direction, provides information, data, legal advice, and support for the general counsel and other program areas. Supervisory attorney overseeing lower-level attorneys and support staff. Assist in providing legal advice and recommendations on the most complex legal issues. Directs and coordinates legal programs or major division of state agency. Provides hands-on counsel to all levels of executive staff and assists in protecting an agency's legal interest and maintaining its operations within the scope established by law. This class differs from that of the Associate Counsel, who performs work of lesser scope and complexity.

Key Responsibilities

Provide support to the General Counsel and Deputy General Counsel on special projects and any other issue assigned in a timely manner.

Remain flexible for assignment of other legal responsibilities.

Provide legal advice to Central Office on issues related to due process to individuals who are substantiated as perpetrators of child abuse and neglect.

Litigate employee grievance cases as assigned to a timely conclusion.

Provide legal advice regarding public records requests and respond to said requests.

Act as the legal division’s policy liaison and oversee legal involvement in policy development.

Provide legal advice to the client on all issues related to HIPAA to ensure Departmental personnel have appropriate legal guidance to operate within federal guidelines.

Provide legal advice to DCS staff on issues such as informed consent, TennCare appeals, and Special Needs Trusts.

Review contracts waiting for signature for accuracy and inclusion of appropriate language.

Provide backup support to other Central Office attorneys as designated.

Provide support to the Assistant Commissioner of Finance in a timely manner.

Minimum Qualifications

5+ years of legal experience. An active License to practice law in Tennessee.
