The salary range for level I is $2,924.00 - $3,553.60 biweekly ($36.55 - $44.42 per hour).FLSA: ExemptDEFINITIONUnder close, general or limited supervision, provides legal advice and guidance and performs professional legal work for the Child Support Services (CSS) department; reviews, explains and processes administrative hearings, motions, civil trials and civil contempt hearings; assures compliance of department activities with state and federal laws and County policies and procedures.SUPERVISION RECEIVED AND EXERCISEDReceives close supervision (I-level), general supervision (II and III-levels), or limited supervision (IV-level) from the Child Support Attorney Supervisor. Exercises no direct supervision over staff.CLASS CHARACTERISTICSThis is a multi-level, deep class in which incumbents may be assigned to any of the four levels depending on experience. This is the entry-level Child Support Attorney; learns to perform legal activities for the Department of Child Support Services.Child Support Attorney II:

This is the journey level of Child Support Attorney; performs legal activities for the Department of Child Support Services.Child Support Attorney III:

This is the experienced journey level Child Support Attorney; performs legal activities for the Department of Child Support Services.Child Support Attorney IV:

This is the advanced journey level Child Support Attorney in the series; performs more complex and difficult legal activities for the Department of Child Support Services.Positions in the Child Support Attorney class series are flexibly staffed and are normally filled by advancing from the lower-level classification at the discretion of the Department Head. Progression to each higher classification level is subject to all of the following (i) management affirmation that the position is performing the full range of duties assigned (ii) management approval for progression to the next higher level in the series; (iii) satisfactory work and office performance at the current classification level; and (iv) the incumbent meeting the minimum qualifications for the next classification including any licenses and certifications.Essential Job Functions

Incumbent(s) may not be required to perform all duties listed, and may be required to perform additional, position-specific tasks.For entry-level (I-level) positions, the typical functions are limited and performed in a learning capacity.Represents the county in child support and paternity actions, including but not limited to, making appearances in administrative hearings, motions, civil trials and civil contempt hearings; may be cross-deputized by the District Attorney to handle criminal cases.Performs legal research; writes opinions and briefs; prepares legal opinions.Prepares legal pleadings, briefs and other papers required in connection with trials, hearings and other legal proceedings.Prepares and litigates sensitive and confidential cases; negotiates and resolves confidential and sensitive cases involving child support and paternity.Advises department staff, custodial and non-custodial parents and witnesses regarding legal issues involved in paternity and support actions.Participates in child support services investigations; advises child support agencies on legal issues of duties, functions and obligations.Performs administrative duties; drafts and prepares reports and related correspondence; maintains accurate case records.Performs duties related to handling bankruptcy cases, worker’s compensation cases, and complaint resolution cases.Conducts presentations and training to staff and general public to introduce and communicate the roles and functions of the office; establishes and maintains effective relations with the public and private attorneys in the negotiation of settlements in child support and paternity issues.Assists and coordinates with federal, state and local child services organizations, county departments, and outside organizations.Attends and participates in meetings, seminars and conferences; prepares and presents speeches and reports for internal and external audiences.Adheres to the standards of the Privacy Act of 1974, {U.S.C. § 552A} as amended; maintains and enforces all aspects of confidentiality of client information.Performs related duties as assigned.In addition, Child Support Attorney III performs the following:Participates in major child support services investigations; advises child support agencies on legal issues, duties, functions and obligations; identifies policy and compliance issues, and proposes solutions.Attends and participates in meetings, seminars and conferences; prepares and presents speeches and reports for internal and external audiences.Provides input in developing goals, guidelines, objectives and policies for the department; monitors child support laws and court decisions to assure CSS compliance with state and federal mandates and regulations.In addition, Child Support Attorney IV performs the following:Manages more complex and difficult Title IV-D cases, including but not limited to, complex legal motions, paternity issues, establishment issues, enforcement issues, bankruptcy issues, and/or complaint resolution cases.Guides and assists legal staff on the handling of Title IV-D cases, including but not limited to, reviewing, preparing, and authorizing cases in the department and handling cases in Superior Court, Bankruptcy Court, and/or at the Workers’ Compensation Appeals Board. Guides and assists CSS staff; provides coaching, counseling and assistance on professional responsibilities, and case processing and preparation; prioritizes and assigns tasks; develops staff skills; and provides assistance with negotiation strategy.Minimum Qualifications

Knowledge of:County, state and federal laws, statutes, rules, ordinances, codes and regulations.The County's and the department's policies and procedures.The principles and practices of legal research methods and rules of evidence.The principles and practices of legal, ethical and professional rules of conduct.The principles and practices of negotiating techniques.Court process and legal terminology.Ability To:Understand, interpret and apply relevant statutes, ordinances, codes and regulations.Assess and prioritize multiple tasks, projects and demands.Work within deadlines to complete projects and assignments.Assess, analyze and identify issues, and recommend solutions to problems.Establish and maintain effective working relations with co-workers, other county employees and representatives from other city, county, state and federal agencies.Operate a personal computer utilizing a variety of business software.Education and Experience:Any combination of training and experience that would provide the required knowledge, skills, and abilities is qualifying. A typical way to obtain the required qualifications would be:Juris Doctorate Degree in Law andChild Support Attorney I : NoneChild Support Attorney II : One (1) year of experience in child support and family law.Child Support Attorney III : Three (3) years experience in child support and family law.Child Support Attorney IV : Four (4) years experience in child support and family law.Certifications and Licenses:Must be licensed by the Bar to practice law in the State of California, remain active with all California Bar annual requirements, and maintain a clear criminal record.Must possess a valid US driver’s license upon date of application. Must obtain California driver’s license following hire date per California DMV regulations.Environmental Factors and Conditions/Physical Requirements

PHYSICAL DEMANDSMay be required to lift and carry items weighing up to 30 pounds.WORKING CONDITIONSWork is performed in an office environment.EQUIPMENT AND TOOLS UTILIZEDEquipment utilized includes personal computer, fax machine, and standard office equipment.Disaster Service WorkerAll Butte County employees are designated Disaster Service Workers through state and local law (California Government Code Section 3100-3109). Employment with the County requires the affirmation of a loyalty oath to this effect. Employees are required to complete all Disaster Service Worker related training as assigned, and to return to work as ordered in the event of an emergency.
