Reviews and analyzes cases referred for enforcement or paternity and support; researches applicable laws relating to referred cases; determines which cases are appropriate for establishment or enforcement.
Acts as final decision-making authority regarding the enforcement of referred cases, including, but not limited to: civil contempt; criminal non-support; probation violations in Municipal Court; intervening in Probate Court; preparation and execution of personal property and real property liens; establishment and enforcement of lump sum judgments; and other administrative remedies.
Acts as Special Prosecutor in Bowling Green Municipal Court; possesses sole discretion and authority to file misdemeanors for non-support of dependents.
Presents and argues court cases for agency including civil contempt hearings, criminal non-support hearings, probation violation hearings, paternity pre-trials and trials, and hearings on complaints and motions for child support establishment.
Prepares civil and criminal enforcement, paternity and support establishment cases for hearings and/or trial including: legal research, examination and preparation of witnesses; preparation of all subpoenas; preparation of and response to discovery motions; review of collected evidence and agency records; and other tasks as necessary.
Prepares Bankruptcy Proof of Claims; attends bond hearings and miscellaneous motion hearings.
Prepares necessary civil or criminal complaints and motions and files cases with appropriate courts; prepares judgment entries for civil cases; conducts legal research and prepares legal briefs, memorandums and pleadings; drafts formal opinion requests; drafts and reviews other documents for the agency as needed.
Provides legal advice, consultation, and research on general child support issues including interpretation and application of laws, rules and procedures to agency personnel including case managers and supervisors.
Discusses and explains current status of cases and legal decisions pertaining to cases in enforcement with obligees; negotiates cases with obligors and/or their attorneys; answers legal child support inquiries for court staff and defense attorneys.
Files objections to Magistrate Decisions and other appeals.
ADDITIONAL FUNCTIONS
Maintains hearing and trial calendar; prepares documents as needed; proofs typing of legal support staff.
Calculates child support order amounts; researches location of obligors and gives instructions for service of papers; follows up with courts on case status; prepares case status tracking reports.
QUALIFICATIONS:
Jurist Doctor supplemented by one year experience as an attorney, or any equivalent combination of education and experience that provides the requisite knowledge, skills, and abilities for this job. Valid driver’s license required.
