ExemptPosition Summary

Responsible for assisting the Senior Vice President of Legal (SVP of Legal) in handling legal matters referred to the department including, without limitation, drafting and monitoring complex contracts/Memorandum of Understanding (MOU)’s, assisting in the negotiation and documentation of real estate development and acquisition transactions, and drafting other documents, as required. The incumbent handles fair housing complaints and serves as the Agency’s Hearing Officer, assists with reasonable accommodations processing, domestic violence transfer processing, and provides guidance and counseling to all Charlotte Housing Authority (“CHA” or “Agency”) staff, providing training sessions on fair housing, domestic violence, court procedures, handling and/or servicing forcible entry and detainer cases, and other in-house litigation matters. The duties listed below are intended only as illustrations of the various types of work that may be performed.Responsibilities

Assists SVP of Legal by preparing litigation documents, researching legal issues and preparing legal memoranda, ensuring compliance with applicable state and federal procurement laws and regulations, and responding to state and federal public information and Freedom of Information requests in each instance.Provides both oral and written legal advice in reviewing proposed and/or current policies to ensure compliance and consistency with state and federal guidelines.Indexes and summarizes depositions and prepares witnesses for court appearances.Conducts necessary legal research to develop legal opinions on various matters for Agency activities and responds to staff general legal inquiries.Reviews standard Agency forms to ensure federal and state compliance, drafts legal documents and reviews departmental requests for real estate documents, service contracts, or other legal documents and returns to department with final legal recommendations.Represents the Agency in district court. Obtains resident file and other records from relevant departments, conducts a preliminary review, gathers facts, and conducts interviews of prospective witnesses to prepare for court proceedings, including trial.Assists with monitoring administrative cases, including resident and/or similar issues.Provides legal counsel and training to staff in the monitoring of regulatory compliance.Represents the Agency in all District Court evictions cases as well as some small claims cases and assists staff in preparation for eviction cases.Counsels the Property Management and Community Safety Divisions in preparation for small claims and District court cases and represents the Agency as needed.Reviews, revises, and processes all lease termination letters.Provides staff training on domestic violence, fair housing, and reasonable accommodations.Prepares legal briefs and opinions, and files appeals in state and federal courts of appeal.Interprets laws, rulings and regulations and studies the constitution, statutes, decisions, regulations, and ordinances of quasi-judicial bodies to determine ramifications of cases.Reviews legal publications or notices for pertinent information and disseminates to appropriate personnel.Assists with processing of all reasonable accommodations’ requests.Assists with processing all domestic violence transfer requests.Acts as the Agency’s hearing officer and conducts formal and informal hearings on rent disputes, evictions, 504 decisions, FSS decisions, rent calculations, termination of rental assistance and related problems, and other issues deemed appropriate by the SVP of Legal. Prepares decisions on formal and informal hearings and maintains relevant records.Performs other duties as assigned.Education and Experience

Juris Doctor Degree from an accredited law school and a license in good standing to practice law in the State of North Carolina. Real estate and litigation experience preferred. An equivalent combination of education and experience may be considered.Knowledge and Skills

Knowledge of North Carolina and applicable federal laws relating to court proceedings, civil actions, pleadings, trial, etc.Knowledge of North Carolina and applicable federal laws and regulations relating to insurance, government procurement, Open Meetings, Freedom of Information Act, fair housing, affordable housing, North Carolina Property Code and eviction proceedings.Mature professional judgment and a high degree of initiative.Strong organizational and analytical skills.Ability to communicate clearly and concisely, orally and in writing, to attorneys, court personnel, the general public and to staff.Ability to take direction and work with others under stressful conditions.Ability to communicate in an advisory capacity and relate to persons of diverse backgrounds and abilities and establish and maintain effective working relationships with others.Supervision Controls

The employee receives instruction from the Senior Vice President of Legal but is expected to have the demonstrated ability to exercise independent judgment as appropriate. Normally, the employee plans and carries out routine work activities with minimal supervision and independently resolves problems that arise. Instructions to the employee may be general or specific in nature. In dealing with problematic issues, it is anticipated that the employee will consult with the supervisor. The employee's work is reviewed for conformity to organizational policies and attainment of objectives.Guidelines

The employee follows the Agency's policies and procedures, HUD regulations, legal resources, and federal and state laws and regulations, in accomplishing assignments. Methods for accomplishing routine work are at the discretion of the employee, subject to existing practices and procedures. When unusual situations arise, the employee may request guidance from the supervisor.Complexity

The employee performs a variety of legal tasks in varying degrees of complexity, but which are all sensitive in nature. The employee is required to exercise personal judgment in making decisions in accomplishing assignments. Some tasks are very complex and require superior knowledge and intellect to solve them.Scope and Effect

The employee's work affects the CHA’s operational effectiveness in providing sound legal advice to the Housing Authority. A good job performance by the employee enhances the Agency's ability to provide housing and assistance to residents.Personal Contacts

The employee has contact with Housing Authority employees at all levels and with various categories of persons including attorney court personnel, the public, residents, business firms, contractors, consultants, insurance agencies, representatives of various social service, educational and city agencies. The primary purpose of contacts is to gain, clarify, or give information; plan, coordinate, and advise on work efforts; motivate, influence, or direct persons or groups; and to justify defend, negotiate, or resolve controversial matters or issues.Physical Requirements

Work is principally sedentary, but may involve some physical exertion, such as kneeling, crouching, or lifting to obtain files, records, and office supplies, and eyestrain from working with computers and other office equipment.Must be able to sit and/or stand for up to eight hours at a time while performing work duties.Must be able to bend, stoop, push, and pull in the performance of office related duties.Must be able to use fingers bilaterally and unilaterally to operate office equipment.Must be able to perform essential job functions in an environment that will sometimes include increased levels of work-related stress.Must have vision and hearing corrected to be able to fulfill essential job functions.An employee may request a reasonable accommodation to mitigate any of the physical requirements listed above.Work Environment
