Posted Monday, January 22, 2024 at 5:00 AMROLE SUMMARYThe Director, Government and Commercial Contracts will:Have demonstrable experience in and thorough knowledge of the U.S. federal marketplace, including, but not limited to, US DOD (United States Department of Defense), BARDA/CDC/SNS (Biomedical Advanced Research and Development Authority), Veterans Affairs (FSS), DLA (Defense Logistics Agency) and other government agencies.Support international government contracts and responding to RFI’s and RFP’s for government funded development opportunities. This will require experience in managing complex federal contracts from cradle-to-grave.Lead and assist with government affairs initiatives to support the GHS business.Strategically develop contract proposals and agreements that maximize revenue while ensuring compliance with all laws and regulations, including complex financial analysis, in close collaboration with Kindeva’s finance colleagues.Direct Kindeva colleagues to ensure compliance with government contracts by providing proactive strategy and operational discipline.Direct and participate in the development of bid strategies and coordinate efforts to produce winning proposals consistent with approved strategies and government regulations.Support the sales and project management teams by offering solutions and guidance relative to contract compliance to mitigate business risk while balancing the business goals of the organization.Partner with finance compliance to support audit requests and respond to government inquiries.Provide strategic guidance on contract execution for international government sales of commercial products.Chair the proposal review committee and ensure that all proposals receive the appropriate level of internal due diligence and governance review before external submission.Be the main POC for the respective Contracting Officers, and will take the lead in negotiating all contracts and amendments.Present recommendations to the Leadership Team for approval, administer the said agreement during the term, develop amendments or communications to the customer, track lifecycle of contracts and analyze contract performance and report results to the Leadership Team.Monitor FedBizOpps and other outlets for contract solicitation opportunities and report findings and recommendations to respond to management. Develop, manage and direct capture and response teams including external consultants. Evaluate current processes and develop strategy and plan for long term government contracts sustainability.Will develop, implement and manage new and existing commercial contracts with pharmaceutical wholesalers and distributors to include the GHS product portfolio.Grow, mentor, and develop other government contracts colleagues and work towards establishing a cross business-unit government contracting Center of Excellence.ROLE RESPONSIBILITIESThe essential duties of this position include but are not limited to:Develop and execute contractual pricing strategies including the ongoing compliance with federal best pricing practices and the implications commercial pricing may have on government pricing.Establish and maintain relationships with Contracting Officers, Project/Program Managers and all relevant government colleagues.Maintain compliance with all internal organizational Kindeva policies and procedures regarding the sales of pharmaceutical products.Maintain compliance with external regulatory policies and procedures regarding the FAR, DFAR, and other government procurement regulations.Maintain professional and technical knowledge by attending educational workshops; reviewing professional publications; establishing personal networks; participating in professional societies.BASIC QUALIFICATIONSMBA with 10+ years of relevant experience, or equivalent combination of education and experience.CPA or demonstrable post graduate business/finance certification.Knowledge and application of the Federal Acquisition Regulation (FAR), (DFAR).Strategizing, managing, developing and writing government contract proposals in the Defense and US Government space.Solid business acumen with excellent communication skills for a wide variety of audiences, both internal and external.Comfortable working under constant deadlines, challenging the status quo, challenging customers and the ability to manage multiple tasks simultaneously.Comfort with ambiguity, ability to act without having the total picture.Ability to work effective collaboration with cross functional teams across the organization to drive processes and contract compliance.PREFERRED QUALIFICATIONS:CFCM (Certified Federal Contracts Manager) is highly preferred.Knowledge, experience with Global Trade Export laws and regulations is highly desirable.Contract law knowledge and international defense contract management experience is desirable.Safety for our employees and our communities is a key priority for Kindeva Drug Delivery.
