The Alternate Municipal Court Judge is appointed for a two (2) year term by the City Council, and the current term being filled starts January 1, 2025, and ends December 31, 2026. The Alternate Judge is under the administrative direction of the Presiding Municipal Court Judge.Responsibilities

Performs Alternate Municipal Judge duties as outlined above and in Texas State law including but not limited to:

This job primarily involves weekend duties to magistrate arrestees for Class C and signing arrest and search warrants as needed for Class B or above offenses as well as Search Warrants. Weekends to serve will be assigned in advance and usually involves one to two hours per day for the jail duties. May occasionally be required to fill in when the Presiding Judge is unavailable during the week. Alternate Judges will be "on call" for warrants, search warrants and magistration of prisoners during the weekend but may use video or email to execute the process.Determines innocence or guilt (when hearing cases without a jury) and levies fine or sets bail appropriate with violation in such a manner as to preserve equity and uniformity in the application of existing laws and ordinances.Accepts pleas, imposes fines in a jail setting.Reviews and signs affidavits for search and arrest warrants.May preside over Municipal Court for all class "C" misdemeanors; holds court sessions to hear persons accused of violating city laws, ordinances, and other misdemeanor violations within the jurisdiction of the Municipal Court when assigned.Performs Judicial and Magistrate duties as outlined in Texas State law including but not limited to:

Magistrate’s prisoners (informs inmates of their rights, sets bonds).Issues warrants, search warrants, writs, summons, magistrate warnings, etc.Signs various paperwork such as arrest warrants, prisoner transfer documentation, appeal bonds, and affidavits.Must be able to prepare paperwork for weekend magistration.Regular and consistent attendance for the assigned work hours is essential.Most of these duties are performed via Zoom virtually.Education, Experience, and Certifications

The judge must:

Be a citizen of the United States and be a resident of this state.Juris Doctorate Degree in law from an accredited scholastic institution.Be a licensed attorney in good standing with the State Bar of Texas; and have two (2) or more years of experience in the practice of law in this state.Two (2) year municipal court experience in a judicial capacity or as a prosecutor.Must maintain a current status with the State of Texas concerning Rules of Judicial Education.Will be required to pass a pre-employment drug screen and criminal background check.Must possess a valid State of Texas Drivers License.Have experience and understanding of lncode software from Tyler Technologies would be helpful.Must take the 16-hour Judicial Training course approved by the Texas Municipal Court Education Center within a year of appointment and then each year thereafter.Required Knowledge and Skills

Knowledge of ordinances, statutes, and court decisions relating to Municipal Court jurisdiction.Knowledge of judicial procedure and rules of evidence.Knowledge of the Code of Judicial Conduct.Knowledge of the organization, duties, powers, limitations, and authority of the Municipal Court.Ability to analyze evidence and data presented in court, to apply existing laws impartially, and to render prompt and equitable verdicts.Ability to effectively communicate verbally and in writing.Ability to express legal interpretations clearly, concisely, and in a forthright manner using a vocabulary level understandable to parties concerned.Ability to avoid conflict or appearance of conflict of interest in the performance of assigned duties and responsibilities.Must be proficient in the use of personal computers and modern office equipment.Must become familiar with the Addison Way and apply that when dealing with the Accused.Physical and Work Environment

Work is performed in a jail setting or court room setting. Incumbent will be required to fill in forms for the magistration of prisoners on the weekend (no Clerk provided). May be exposed to hostile or angry citizens and criminals.Equipment and Tools Utilized

Incumbent will be required to use lncode, a software program for Court, to execute judgments and reviews of judicial queues when the Presiding Judge is not available. Ability to use video equipment such as Zoom to magistrate Class C prisoners remotely would be necessary.EEO Statement
