The Minnesota Competency Attainment Board (Board)

is looking for a dynamic and motivated individual to provide legal advice, analysis, and related services to support the ongoing operations of the Board. The Staff Attorney position will provide legal counsel on a variety of complex and evolving topics applicable to the diverse activities of building a new state agency that is centered on providing competency attainment and forensic navigator services statewide.This position is an advanced professional level position and reports to the Program Administrator. The individual in this position collaborates with internal and external stakeholders in support of the Board’s vision to promote wellness, safety, and justice in Minnesota by building pathways for competency attainment through collaboration, accountability, and innovation.This position requires substantial knowledge of state and federal laws, and of the Board’s unique role as an independent Board/state agency within the judicial branch structure. The Staff Attorney’s legal work may include litigation, rulemaking, legal advice and consultation on program policy and direction, contracting, and other related legal functions. The Staff Attorney must be comfortable exercising individual judgment to provide thorough advice on a variety of complex and unique legal scenarios.Primary Responsibilities

Essential Responsibilities and DutiesThese are examples of typical responsibilities and duties; the list is not all inclusive and may change over time as the agency develops and grows.Specifically, this position provides legal advice to the Board and Program Administrator on issues including, but not limited to, Competency Proceedings as outlined in Minnesota Statutes §§ 611.40 – 611.59, Minnesota Rules of Criminal Procedure, and the Minnesota Commitment and Treatment Act as it relates to competency attainment.Analyzes legal questions and advises the Board and Program Administrator, and other employees as appropriate, concerning business transactions, claim liability, and legal rights and obligations.Provides legal advice regarding relevant rules, laws, court orders, and other legal and/or regulatory materials.Provides legal advice and consultation on matters that affect the Board and its employees, such as employment law and contracts and financial matters.Prepares and contributes to proposed drafts for legislative matters that affect the Board and its employees.Maintains knowledge and awareness of operations, conducts legal review of agency policies and procedures and the certification processes for competency attainment programs to ensure consistency with other policies, procedures, applicable statutes, rules, and regulations.Coordinates claims against and litigation affecting the Board and the agency, including state and federal litigation.Acts as a subject matter expert for and may conduct training programs on legal policies and practices for employees and stakeholders.Performs work on other projects and responsibilities as assigned.Qualifications

Legal or Licensure Requirements(These must be met by all employees prior to attaining permanent status)Juris Doctorate from an ABA accredited law schoolLicensed to practice law in Minnesota with active status and good standing.Other QualificationsAny combination of training, certifications, or work experience demonstrating the knowledge, skills, and abilities listed above will be sincerely considered. Examples of acceptable qualifications include:

3 or more years of professional legal experience in the practice of law.Experience working with government agencies is preferred.Knowledge and experience with criminal law and/or mental health is a plus.Preferred candidates will also have a variety of experiences working effectively with individuals from different backgrounds and cultures.Knowledge, Skills, and Abilities

Deep knowledge of multiple areas of law that can be applied to agency programs and practices through the application of complex legal principles and precedent.Knowledge of state and federal laws, rules, and procedures applicable to government agencies.Understanding of Minnesota’s legislative process.Knowledge of legal research methods and strategies to develop recommendations, opinions, and legal analysis in support of the Board’s goals and objectives.Ability to identify legal risks and policy implications when providing legal advice to the Board, Program Administrator, and others as appropriate.Ability to educate Board members, agency leadership, employees, legislators, partners, and the public on the laws, rules, and programs relevant to the Board.Ability to develop and maintain inclusive and effective working relationships.Exceptional communication, active listening, interpersonal skills, and an ethical mindset.Adept at problem-solving, negotiating, and resolving conflicts.Skill in handling multiple, competing tasks and priorities and the ability to perform well under pressure.Experience using Microsoft Office products to produce documents and familiarity with database management systems and information technology.Supplemental Information

About the PositionThe position will work normal business hours, Monday-Friday. The position is hybrid with work conducted from a remote work location and in-person work performed at the Minnesota Judicial Center located in downtown St. Paul, Minnesota. The position requires occasional travel throughout the state.About the Minnesota Competency Attainment BoardThe Board was established by legislative action in 2022 and 2023, and is charged with creating and administering a statewide, independent competency attainment system as required by Minn. Stat. §§ 611.40 through 611.59. This includes establishing a system that certifies competency attainment programs and uses forensic navigators to support individuals in the competency process. The Board is committed to providing these services to support individuals and to assist the courts and partners in coordinating competency attainment services and coordinated community transitions.
