Join us.Greenway is seeking a corporate counsel to serve as the company’s Privacy Officer and to assist with privacy, security, data usage and healthcare regulatory matters. The successful candidate will have considerable experience in healthcare and with privacy matters under HIPAA and state laws. S/he will ensure full coordination and documentation across all departments involved in any way with HIPAA privacy and related security laws. S/he will also be responsible for regulatory research and analysis of applicable privacy laws and regulations and ensuring compliance therewith.The ideal candidate will also have experience in healthcare technology, healthcare laws generally, including the Anti-Kickback Statute, False Claims Act and the 21st Century Cures Act.The position is based in Tampa, FL.Essential Duties & ResponsibilitiesThe candidate will be responsible for:PrivacyBeing the company expert on HIPAA privacy laws, rules and regulations and administering the Company’s overall HIPAA privacy program with respect to employees, clients and vendors.Preparing and implementing effective HIPAA and privacy training and policies and procedures throughout the entire organization to ensure that any changes in regulations are communicated in a timely manner and understood by all.Assist management in coordinating internal compliance reviews and monitoring activities and third-party audits, including annual or periodic reviews of departments and periodic vendor and client audits.Implement and maintain an effective incident response program, including, but not limited to managing outside counsel, insurance claims, forensics experts and others as necessary.Work closely with the Chief Information Security Officer to evaluate appropriate technology solutions to safeguard, map and maintain PHI and PII.Review software functionality to evaluate and analyze privacy and security implications.Be the subject matter expert on business associate agreements, data usage agreements and other forms of agreements where privacy, security and data usage is implicated.Advise on and implement programs regarding data rights and usage, data de-identification and data monetization.Oversee the legal aspects of the company’s generative AI procedures.Regulatory AdviceAdvise on new regulations impacting electronic health records developers, including the 21st Century Cures Act and other ONC, CMS and state regulations.Advise on regulations applicable to clearinghouses and revenue cycle management operations.Act as primary attorney responsible for ensuring compliance with the Anti-Kickback Statute and the False Claims Act.Education and ExperienceBachelor’s Degree and JD required.IAPP or HCCA Privacy Certification preferred.Applicable state bar licensure or in-house counsel qualification.Six (6)+ years of legal counsel experience in a healthcare organization with oversight of privacy matters.Combination of law firm and in-house experience preferred.Skills, Knowledge, and AbilitiesA self-directed problem-solver with a proven ability to take ownership of a variety of projects with little oversight and supervision.Strong communication (both verbal and written), diplomacy, and the ability to establish credibility necessary to effectively influence company employees and executives.The successful candidate will be a transparent and collaborative leader comfortable spearheading and supporting change in a complex environment.Willingness to be flexible and adaptive and demonstrate a desire to operate in a dynamic and high-growth environment.Must possess high integrity.Creative problem solver who possesses sound business judgment and is detail-oriented.Strong quantitative and qualitative analytical skills.Outstanding strategic planning and management skills.Ability to integrate and balance priorities, work activities and resources for the benefit of multiple key stakeholders.Ability to work in a fast-paced working environment.Ability to exercise discretion and make independent judgment regarding significant department managerial, business workflow, and legal matters.Excellent written and oral communication skills.Excellent attention to detail and organization skills with the ability to manage multiple priorities.Demonstrated PC skills, proficient with Microsoft Windows applications.Will be required to utilize discretion and independent thinking and judgment regarding matters of significance to the organization.Demonstrated skills with utilizing current technologies in support of the organization such as Microsoft Office, Compliance 360, file management systems and other applicable hardware/software programs.Ability to travel as needed.Work Environment/Physical DemandsWhile at work, this position is primarily a sedentary job and requires that the associate can work in an environment where they will consistently be seated for the majority of the workday.This role requires that one can sit and regularly type on a keyboard the majority of their workday.This position requires the ability to observe a computer screen for long periods of time to observe their own and others’ work, as well as incoming and outgoing communications via the
