ABOUT THE DEPARTMENT

The Shasta County Public Defender provides efficient and effective legal defense services to indigent individuals charged with crimes in felony, misdemeanor, and juvenile matters. In addition, the Office of the Shasta County Public Defender provides legal representation to indigent individuals facing conservatorship, guardianship, parental terminations, probate, and Welfare & Institutions Code Section 5150 proceedings.

ABOUT THE POSITION

Under administrative direction, to plan, organize, and direct the legal activities and services of the Public Defender’s Office; and to do related work as required. This position is an unclassified, at-will position.

IDEAL CANDIDATE

The ideal candidate will be a fair, competent, and consistent criminal defense attorney with a broad legal background and significant senior management experience overseeing work of subordinate attorneys; someone who actively fosters communication and collaboration among the leadership of the criminal justice community, with other county agencies, and the Board of Supervisors; a creative, visionary, and approachable leader; an effective and competent manager with exceptional interpersonal skills; a team builder and conflict mediator; a competent fiscal manager; someone who serves as a role model and expects others to strive for exceptional performance.

RESPONSIBILITIES

Plans, organizes, and directs a program for providing legal counsel and representation to eligible persons accused of criminal offenses.Formulates and applies policies related to the Public Defender’s Office.Assigns criminal calendar to appropriate staff members.Consults with staff on the conduct of cases in progress and gives advice and assistance as necessary.Directs procedures to determine eligibility for Public Defender’s Office services.Reviews and evaluates completed staff work.Discusses the public defense program with judges, prosecutors, law enforcement officials, and other persons to obtain information and possible action relative to defendants.Personally appears in court as defense attorney of major and other cases or at arraignment to obtain first-hand knowledge of cases going to court.Confers with office staff on record keeping and reporting systems and initiates changes as required.Prepares and administers departmental budget; prepares correspondence and reports.MINIMUM REQUIREMENTS

Any combination of education and experience sufficient to directly demonstrate possession and application of the following:

Knowledge of:

philosophy and practice of indigent defense in the United States; duties, powers, limitations, and responsibilities of indigent defense counsel; principles of criminal law and its application; trial and hearing procedures; rules of evidence; legal research methods; principles of supervision and training.

Ability to:

Successfully defend criminal cases; perform legal research; analyze and apply legal principles, facts, evidence, and precedents to complex legal problems; present law, facts, evidence, and arguments clearly and logically in written and oral form; effectively represent the Public Defender's Office in legal proceedings and hearings; deal effectively and tactfully with members of the legal profession, public officials, and other persons contacted in the work; train, supervise, and evaluate staff.

These employment standards are typically attained with at least five years as a practicing attorney, including at least three years in the practice of criminal law.

SPECIAL REQUIREMENT

Active membership in the State Bar of California; possession of an appropriate California Driver License.
