Job SummaryManages and administers estate and trust estate gifts that benefit The Salvation Army, Arkansas and Oklahoma Division, and its constituent entities; arranges for legal counsel to assist The Salvation Army, Arkansas and Oklahoma Division, as needed in the estate process, e.g., mediations, trials, estate counsel, etc.; coordinates with legal consultants organized in monitoring and managing the estate process of certain estates and trusts of which The Salvation Army is beneficiary. Also assists in the coordination including consultation with the General Secretary and the HR Director, on all legal issues to include reviewing subpoenas, lawsuits, etc. and coordinates with Bo-MC on all Mineral Rights Issues.

Plans, coordinates, supervises, evaluates, and participates in the administration of a broad range of legal documents requiring paralegal oversight to support the Texas Division specializing in estate and trust estate gifts, employment matters and commercial contracts. Serves as liaison with legal counsel and provides paralegal assistance between Legal Counsel, Governmental Agencies, Divisional Headquarters and Territorial Headquarters. Assists all field offices with training/knowledge of the proper administration of legal documents. May supervise and coordinate activities of support staff.

Knowledge, Skills, and Abilities- Manages and administers estate and trust estate gifts that benefit The Salvation Army, Arkansas and Oklahoma Division, and its constituent entities.- Arranges for legal counsel to assist The Salvation Army, Arkansas and Oklahoma Division, as needed in the estate process, e.g., mediations, trials, estate counsel, etc.- Researches and examines law sources such as statutes, recorded judicial decisions, legal articles, and legal codes to prepare legal documents such as briefs, pleadings, EEOC charges, wills, agency complaints, contracts, buy-sell agreements, closing papers, deeds, and trust instruments for review, approval, and use by Attorney.- Reviews all subpoenas received within the Division; delivers or directs delivery of subpoenas to witnesses and parties to action; obtains appropriate related information for further review or discussion at the Divisional and Territorial level.- Reviews all lawsuits received within the Division, coordinates appropriately, monitors, and gathers facts along with documentation, etc.; prepares recommendations for the Divisional Finance Board and Board of Trustees.- Tracks all legal cases and required responses along with the associated deadlines in order to ensure all involved parties and documents are ready as scheduled and required for compliance.- Investigates facts and law of case to determine causes of action and to prepare case accordingly. May act as liaison between disputing parties.- Participates in mediations on behalf of The Salvation Army when assigned and to ensure that decisions and information shared is within assigned instructions.- Prepares affidavits of documents and maintains document file.- Assesses and inventories real and personal property for estate planning.- Coordinates with legal counsel organized in monitoring and managing the estate process of certain estates and trusts of which The Salvation Army is beneficiary.- Maintain Interchange database to ensure accuracy and up to date information. Pull reports for Officers as necessary to keep them apprised of information. Track and follow on estate and recovery process.- Works directly with the Divisional Administration, (to include Planned Giving), local corps officers and program directors, and Territorial Headquarters to properly and appropriately administer all estate and trust estate gifts benefiting the Arkansas and Oklahoma Division.- Manages and administers all estate related functions and tasks with a focus on establishing and maintaining a high standard of integrity and accuracy.- Evaluates existing estate management database and make recommendations regarding the establishment, development, and maintenance of an organized system for collecting, keeping, maintaining, and transmitting all records and correspondence related to each estate, including records of all phone messages and conversations not otherwise committed to writing.- Prepares Divisional Finance Board (DFB) recommendations, as needed, in order to properly administer estates; informs and receives guidance from the DFB in its capacity on behalf of the Division to oversee all elements of Salvation Army business (including estates and gifts derived from them), and to fulfill the DFB responsibility to transmit recommendations affecting estates to the THQ Estate and Legacies Department and Territorial Executive Council when appropriate.- Prepares DFB recommendations for distributions in a timely fashion upon receipt of the copy of the Will or Trust for the estate in accordance with the dispositive provisions of the instruments and current policies related to the distribution of gifts benefiting The Salvation Army.- Communicates and cooperates with the various Adult Rehabilitation Centers serving throughout the Arkansas and Oklahoma Division to obtain their assistance with estate cleanouts of apartments or homes when needed.- Liquidates estate gifts in kind such as real property, mobile homes and trailers, mineral interests, collectibles (art, stamps, coins, etc.,) utilizing whatever reputable resources that may be appropriate or available while keeping the DFB informed and seeking appropriate approvals.- Arranges for all promissory notes inherited from estates, usually secured by a collection vendor whose purpose is to act, when authorized to do so, as an agent on behalf of The Salvation Army in order to collect monies pursuant to the terms of promissory note and other contracts; transmits collected monies to The Salvation Army and a record of payments to the payor, and maintains appropriate collection records throughout the life of the note or contract until paid in full or reassigned.- Communicates in a knowledgeable way with attorneys, personal representatives of estates, successor trustees of trust estates, and family members of decedents in all matters pertaining to estates naming The Salvation Army as beneficiary.- Develops and maintains appropriate standardized correspondence to be used with most estates in initial communications with attorneys, personal representatives, and successor trustees as appropriate.- Develops, maintains, and presents estate tracking reports as defined and requested by the DFB and the General Secretary. Monitors and tracks all estate submissions to Territorial Headquarters. Manages and tracks receipts for distributions.- Prepares and transmits copies of all records, correspondence, and messages to the THQ Estate and Legacies Department.- Process legal invoices for payment to local counsel on Trust/ Estate issues.- Researches and coordinates with Bo-Mc on all mineral rights issues to determine ownership and Estate/Trust status.- Ensure all mineral right information is entered and tracked in database.- Create and maintain a Procedures Manual for the position to include reviewing policies and updating as needed in the Trust/Estate area.- Conducts all duties in accordance with the prevailing state and local legal standards for administration of estates, current applicable Salvation Army Southern Territorial policies and procedures while guided by the mission of The Salvation Army to serve others with integrity and honest communication.- Special projects as necessary.- Performs other related work as required.- Knowledge of The Salvation Army mission, philosophy, culture, protocol, and organizational structure.

Education and Experience- Associate Degree from an accredited college or university in paralegal studies or equivalent formal paralegal education with a Paralegal Certification is required with a Bachelor’s degree in Legal Studies preferred.- Three years’ progressively responsible paralegal work experience with specialized experience in estate/probate, employment law and contract administration are required with supervisory experience preferred.- Any equivalent combination of training and experience, which provides the required knowledge, skills, and abilities.

Certifications/Licenses- Valid Oklahoma Driver’s License- Notary Public Certification- Paralegal or Legal Assistant Certification is required.

Physical Requirements/Working Conditions- Ability to exhibit a caring and sensitive attitude toward all persons involved with the probate or estate administration process, especially family members of the decedents.- Ability to cultivate and maintain effective relationships with a diverse group of people and remain sensitive to their concerns.- Ability to present a positive and professional image of The Salvation Army.- Ability to prepare and maintain reports in an accurate, complete, and timely manner.- Ability to work independently and with limited supervision.- Ability to build and maintain effective working relationships with Salvation Army officers, employees, member of advisory organizations, and the community.- Ability to read and interpret policies/procedures, legal documents and requirements to ensure compliance.- Ability to administer budgets and monitor expenditures for compliance with the same.- Ability to organize and efficient and have experience initiating and maintaining legal files and records, including related financial and accounting transactions and records.- Ability to meet attendance requirements.- Ability to read, write, and communicate the English language effectively.- Ability to communicate clearly both orally and in writing including the providing of clear instructions to employees.- Ability to work under the pressure of deadlines and time constraints.- Ability to establish goals and objectives and monitor their effective implementation.- Ability to apply discretion and independent judgment and exercise confidentiality.- Ability to perform all duties with an understanding of the mission, ministry, philosophy, culture, and protocol of The Salvation Army and conducts all duties in accordance with the ministry of the organization and its Christian principles; conducts all communications and job duties with the highest level of professionalism.

Duties are usually performed seated. Sitting may be relieved by brief or occasional periods of standing or walking. Limited amount of physical effort required associated with walking, standing, lifting and carrying light objects (less than 25 lbs.) 5-10% of work time. Work may be performed in an office environment where there are little or no physical discomforts associated with changes in weather or discomforts associated with noise, dust, dirt, and the like but not limited to the office environment.
