DEFINITION

The Director of Property and Liability, under supervision of the Trindel Insurance Fund Executive Director, is responsible for the management of claims staff; timely and accurate claims processing of all member property and liability claims from filing to closure, in accordance with Trindel Insurance Fund’s Claims Handling Guidelines. Works closely with Member County staff, and attorneys; negotiate settlements to achieve the best possible outcome in the claim.

The Director of Property and Liability accomplishes this by analyzing loss trends, effective management of the claim cycle, setting/managing program reserves, conducting and directing investigations, site visits and active claim management. Includes prompt processing of claims for payment, implementation and execution of litigation management guidelines, excess carrier notification, managing the claim property and liability claims department staff to ensure they are handling claims in compliance with established claims handling guidelines while providing effective strategies that result in positive outcomes.

DIMENTIONS

The Director of Property and Liability will supervise, develop, guide and mentor property and liability department employees for effective claims management. The Director shall lead and direct the staff, plan work schedules, assign, delegate and evaluate work on a regular and on-going basis. Provide corrective action as needed. The Director of Property and Liability works closely with all Trindel member counties to provide effective service and programs to meet client needs.

· Overall responsibility to manage and direct operation of the Trindel Insurance Fund property and liability program.

· Receives, reviews, and directs disposition of claims filed against member entities as well as the member entities first party property damage claims.

· Establishes and maintains property and liability claim files, reserves, and loss data.

· Responsible for investigation, evaluation of liability and damages, negotiating and settlement, litigation management, and final disposition of property and liability claims.

· Overall responsibility for management of data base and loss history.

· Responsible for preparation of written reports, general correspondence, special reports, and projects related to property and liability claims.

· Supervises and directs staff, outside adjusters, and attorneys in the handling and disposition of claims.

· Attends settlement conferences, meetings, and trials as necessary to effectively manage litigated cases.

· Attends Board, Member County Board of Supervisors Meetings, and Executive Committee meetings, reports on status of property and liability claims and makes recommendations as to action on claims.

· Responsible for initial review of claims for coverage analysis.

· Coordinates and communicates with Trindel’s excess insurance provider for coverage determinations related to property and liability claims.

· Prepares reservations of rights notices, declinations of coverage and other communications to member entities relating to coverage and claim status.

· Responsible for maintaining contact and communications with excess providers to assure proper reporting and recovery of excess recoverable and reportable matters.

· Responsible for review and approval of service billings for investigative and legal services, forensic experts, and other service providers related to the claims function.

MINIMUM QUALIFICATIONS - Abilities required for the essential duties:

· Demonstrated leadership and supervisory experience.

· Excellent, demonstrable interpersonal and organizational communication skills.

· Excellent, demonstrable public speaking and presentation skills.

· Excellent, demonstrable writing skills, writes well, clearly and concisely.

· Ability to develop, write and present property and liability training curriculum.

Education & Experience required for the essential duties:

· Four-year degree at an accredited college or university in English, Liberal Arts, Public Administration, or Business and/or Finance.

Three (3) to five (5) years of claims adjusting, or litigation experience required, experience working with public entities preferred.

Desired: Hold a J.D. from an ABA approved Law School, an Associate in Risk Management (ARM), and/or Associate in Claims (liability focus).
