Dallas, TX !Job SummaryProvide decisive day-to-day legal counseling and advice across the enterprise, with an emphasis on the defense of litigation in consumer matters at NMAC. The Counsel will play a key role in representing the company’s interests through management of an active litigation docket, coordinating with other members of Legal, Compliance, and other key internal stakeholders.A Day in the Life:Manage a docket of consumer litigation matters, from pre-filing through post-judgment and appealManage other matters as may be assigned, including class action, commercial, collections, and replevin cases.Interface with dealers concerning the resolution of disputesAdvise on relevant industry, legal, and regulatory developments, including emerging trends and potential impactsCoordinate with internal parties as needed to resolve disputes, including advice concerning consumers and dealers in workoutWork closely with internal business partners to understand their perspectives, processes, applications, projects and technologies to ensure compliance with applicable laws, regulations, and best practicesRepresent Nissan in claims, litigation and investigations arising out of various consumer and commercial financing transactions and before third parties in connection with such mattersCreate and present training for business clients on various legal mattersManage outside counsel, including by defining scope of engagement and supervising day-to-day activitiesEstablish and manage budgets for matters within assigned area of responsibilityCollaborate with fellow attorneys, paralegals, support staff and clients on projects, including representatives from the Company’s regional business & legal departments across the globe and in varying time zones.As necessary, perform other related duties of which the above are representativeProvide corporate governance support as assistant corporate secretary as may be requested by the General Counsel and Board of DirectorsWho We’re Looking for:Experience managing litigation, including in the consumer, commercial, financial services, intellectual property, contract, and regulatory contextsExperience with arbitration, including enforcement of agreements to arbitrateExperience managing regulatory investigations, internal investigations, and document and testimonial discoveryExperience managing and responding to subpoenasExperience in pursuing affirmative claims on behalf of the Company, including demand for payment under contracts with third parties and collections on outstanding judgments.Experience advising on workout scenarios, including with consumers and distressed dealerExperience managing outside counsel and a team of paralegals. Experience setting and meeting budgetsExperience drafting and negotiating a variety of correspondence and contracts concerning litigation matters, including settlement agreementsFamiliarity with consumer and commercial lending laws, including but not limited to
FCRA, ECOA/Reg B, TILA/Reg Z, CCPA, GLBA/Reg P/Privacy, Fair Lending, UDAAP, TCPA, CAN-SPAM, SCRA, FCRA, FDCPA.Excellent verbal and written communication skillsHighly developed business and technical acumen to understand our business and anticipate the nature and magnitude of issues that could arise in various settings.Excellent legal research and writing skills; attention to detailAbility to communicate effectively with all levels of employees and leadershipBe highly proactive, accountable, team-oriented, and capable of managing multiple competing priorities in a dynamic, cross-functional/cross-cultural business environment.Proficiency with Word, Excel, and PowerPointFamiliarity with legal matter management and billing systemsYears of Experience:3+ years of litigation experience at a reputable law firm and/or in-house at a company that both brought and defended itself in disputes.
