The ideal candidate will assist in advising clients on the development of products and services, drafting and updating privacy-related documents, and providing general privacy counseling. A solid understanding of various privacy laws and excellent communication skills are essential for this role.Duties and Responsibilities:Assist in advising clients on the development and implementation of privacy policies and procedures.Draft and update privacy policies, procedures, training materials, notifications, forms of consent, and related documents.Provide general privacy counseling, including guidance on compliance with privacy laws and regulations.Demonstrate a solid understanding of HIPAA/Healthcare Privacy, consumer privacy, and health information privacy.Familiarize with federal healthcare privacy laws (HIPAA), state healthcare privacy laws (CMIA, Washington My Health My Data Act, Nevada SB 370), and other federal privacy laws (GLBA, FCRA, COPPA, FTC Act).Understand comprehensive state privacy laws, such as the CCPA, and international privacy laws, including the EU’s GDPR.Gain knowledge of general technology and data flows.Draft privacy policies, negotiate privacy-related contracts, and data processing agreements (BAAs, DPAs, DUAs).Provide product counseling and conduct privacy compliance assessments.Investigate, remediate, and draft notifications for privacy and security incidents.Address privacy and cybersecurity issues related to adtech (desirable but not essential).Requirements:2-4 years of experience in healthcare privacy and other areas of privacy law.JD from an ABA-accredited law school with superior academic credentials.Active membership in the California State Bar or District of Columbia Bar, or eligibility to take the next available exam.Strong understanding of HIPAA, CCPA, GDPR, and other relevant privacy laws.Experience drafting privacy policies and negotiating privacy-related contracts.Experience with privacy compliance assessments and handling privacy and security incidents.Education:Juris Doctor (JD) degree from an ABA-accredited law school.Certifications:Active membership in the California State Bar or District of Columbia Bar, or eligibility to take the next available exam.Skills:Solid understanding of healthcare privacy, consumer privacy, and federal and state privacy laws.Experience with drafting and updating privacy-related documents and negotiating privacy-related contracts.Knowledge of international privacy laws and general technology/data flows.Excellent oral, written, and interpersonal communication skills.Strong analytical and problem-solving abilities.Ability to work independently and as part of a team in a fast-paced environment.Superior academic credentials and strong professional references.
