DefinitionUnder broad direction of the General Counsel, performs advanced legal, administrative, and supervisory work with an emphasis upon the management of the day-to-day operations of the General Counsel’s Office. Supervises Senior Counsels, Assistant General Counsels, advises the Community Council, Community Manager, and other Community officials concerning legal issues and activities. Ensures that applicable laws are followed so that tribal sovereignty is protected and enhanced. Provides assistance to avoid or prevent expensive legal disputes and litigation and protects the Community’s legal interests. Treated as FLSA-exempt.

Examples of Tasks

Works closely with the General Counsel in the management of the General Counsel’s Office, and performs the duties of General Counsel during his/her absence.

Recommends hiring, familiarizes new employees with the context and constraints within which their work will be done, guides and develops employees in the accomplishment of their duties and professional growth. In collaboration with the General Counsel, writes and conducts evaluations, and recommends actions; assigns work and monitors its progress. Monitors adherence to all statutes, rules, policies, and procedures by staff; takes proper action when not followed. Ensures that the staff maintains highly technical and specialized knowledge.

Formulates programs and plans for maintaining departmental efficiency and responsiveness. Monitors staff conduct to determine and maintain compliance with departmental standards.

Reviews laws, rules, regulations and legal documents which may have an impact on the Salt River Pima-Maricopa Indian Community and advises the Community Manager, Community Council, Department Heads, Boards and Commissions relative to legal matters affecting the Community. Conducts legal research in areas related to tribal sovereignty, tribal jurisdiction, taxation, membership, heirship, business law, etc. Prepares or directs the preparation and review of legal opinions, drafts, ordinances, resolutions, contracts, deeds, leases and other legal documents and, if necessary, amendments to existing ordinances and policies.

Assists in the preparation of legal and technical correspondence for the President’s, Vice-President’s, Community Manager’s, or General Counsel’s signature.

Ensures continued communication on legal issues among the Community Administration and Department Heads; maintains a sound working relationship with these departments and is sensitive to their needs and concerns. Provides legal advice and representation in employment, including employee discipline and termination, EEOC, FLSA, FMLA, OSHA, NLRB, OSHA, NLRB, NLRA, etc.

Assists with the coordination of federal and state court litigation by outside attorneys. Provides representation for the Community in state court matters as assigned. Negotiates contracts and IGAs on behalf of the Community. Provides legal advice on extraditions and exclusions.

Reviews legal documents, including but not limited to, court decisions, proposed legislation and regulations, to protect SRPMIC interests. Drafts legal documents, ordinances, regulations, policies, position papers, correspondence and executive summaries.

Performs other job related duties that enhance and facilitate departmental operations.

Knowledge, Skills, Abilities, and other Characteristics

Knowledge of the history, culture, laws, rules, customs and traditions of the Salt River Pima-Maricopa Indian Community.

Knowledge of SRPMIC Code of Ordinances, and Community, State and Federal laws, rules, regulations and policies, including Federal Indian law.

Knowledge of the principles and practices of the legal profession.

Knowledge of case law appropriate to the issues and cases being prepared.

Knowledge of legal research methods, legal research software, and use of data bases.

Knowledge of the principles and practices of employee supervision, including selection, training, work evaluation and discipline.

Knowledge of grants and contract negotiation processes.

Ability to communicate orally and in writing with administrative staff, community members, outside entities and coworkers.

Ability to perform legal research.

Ability to analyze difficult and complex legal issues and apply legal principles.

Ability to adapt to changing work situations and assignments.

Ability to exercise resourcefulness in addressing new problems.

Ability to present statements of fact, law and argument clearly and logically, in both written and oral form.

Ability to produce written documents with clearly organized thoughts, using proper sentence construction, punctuation and grammar in a timely manner.

Ability to set priorities to meet established as well as changing deadlines.

Ability to analyze and aid in drafting and commenting on proposed legislative measures.

Skill in interpreting and applying statutes, ordinances and other laws as they pertain to cases.

Skill in interpreting and applying rules, regulations, and policies as they pertain to cases.

Skill in establishing and maintaining effective working relationships with SRPMIC administration, Council members, Community members and appropriate outside entities.

Skill in communicating with, and instructing others, using both technical and non-technical language as appropriate to provide legal counsel and explanations to those for whom the subject matter is unfamiliar and/or difficult to understand.

Minimum QualificationsEducation and Experience:

Graduation from accredited college or university with a Law Degree (Juris Doctor) and seven (7) years of experience as an attorney involving the legal affairs of Native American tribes. Experience that has provided knowledge of social and economic conditions of tribal governments is essential. Preference for in-house tribal government experience in the areas of government finance, tribal finance, tribal tax, human resources, employment benefits, Federal law and regulations in Self-Governance, General Welfare, LTRO, leasing, etc. Experience supervising or managing attorneys is desirable.

Equivalency:

Any equivalent combination of experience and education that will allow the applicant to satisfactorily perform the duties of the job may be considered when filling the position.

Underfill Eligibility:

An enrolled Community Member whom closely qualifies for the minimum qualifications for a position may be considered for employment under SRPMIC Policy 2-19, Underfill.

Special Requirements

Membership in a State Bar and the ability to practice in Federal District Court is required. If not a member of the Arizona State Bar, must be willing to take and pass the Arizona State Bar Exam within one year of employment with the Community. Must attend a minimum of 15 hours annual continuing legal education as related to job and approved by supervisor.

Prior to hire as an employee, applicants will be subject to drug and alcohol testing. Will be required to pass a pre-employment background/fingerprint check.
