Senior Manager/Director of Commercial Management -

ARB, Inc.

ARB, Inc. is seeking a Director of Commercial Management reporting to the SVP of Operations. This individual would have a cradle-to-grave commercial risk assessment and mitigation responsibility in all aspects of the business unit operations including negotiation and management of all contracts with clients and partners from a commercial perspective. This individual would champion the contract management processes with project teams (including change and claims management) and support the legal department in dispute resolution.

Key Responsibilities

Review, redline, and negotiate all contracts (EPC, construction, MSA, consortium, joint venture, subcontract, purchase order) from a commercial perspective with clients and partners.

Represent the company in JV and consortium management boards.

Prepare and present contract risk assessment and analysis to the C suite during risk reviews.

Support project managers in drafting business letters and contract notices.

Lead preparation, presentation and negotiation of complex change order requests and claims including time impact analysis.

Establish trust with clients/partners and promote equitable contract terms.

Work with the proposal teams and develop strategies for a win-win contracting approach.

Review project risk registers to ensure that the reserves are being held is commensurate with the risk.

Examine and analyze claims submitted by subcontractors, suppliers, third parties/second tier entities, further investigating claims to determine validity or contractual entitlement.

Qualifications

Bachelor’s degree from a four-year accredited college or university; MBA is a plus.

At least 8+ years of related contract/change management experience and/or training including 3+ years of on-site EPC construction execution experience specifically in the heavy industrial market (renewables, oil & gas, power generation, or chemical industry).

Extensive knowledge of construction execution risk.

Familiarity and strategic adeptness with various contract pricing models.

Astuteness in cost control and CPM scheduling.

Strong interpersonal, written (including technical writing), and verbal communication skills.

Proficiency in Microsoft Office Suite, Primavera P6, and Microsoft Project.

Possess high integrity and uphold ethical practices.

A team player who promotes and institutionalizes best-in-class contract management practices.

Highly motivated with a demonstrated passion for excellence.

Self-starter with an ability to work independently to meet deadlines, goals, and objectives.

Salary range would be in the range of $150 - 200k commensurate with skills and experience.
