(“Civils”). The position will report to the President and Chief Executive Officer of Buildings and Civils, as well as the General Counsel of Balfour Beatty plc, the United Kingdom-based parent company of the U.S. businesses. Location Ideally, the candidate should be located near one of the existing BB Buildings office locations (the CEO is officed in San Diego, California). Remote position for the right candidate. Needs to be flexible on travel to US-based projects and Leadership Team Meetings, etc., with significant travel anticipated over the first year in order to become familiar with the two businesses and the management teams. Role Purpose The role represents a strategic hire to work closely with the CEO and Chief Legal Officer and to have overall responsibility for the ethics and compliance program for both businesses. The role forms part of the Senior Leadership Team of each business. Additionally, the role will serve as a key liaison with compliance leaders in our sister business in the US and at Balfour Beatty plc. As such, the role will be tasked with both managing and improving a high-quality compliance program for two successful US businesses, and also aligning it with national and global programs. Responsibilities Oversee the management, implementation and continuous improvement of a high-quality ethics and compliance program, building on the work that has already been done by the prior compliance officer. The Senior Vice President of Ethics and Compliance will: Work with senior management to set and reinforce tone at the top in order to promote a culture of compliance around business integrity and ethics. Ensure the effectiveness of the compliance program to encompass legal and regulatory compliance as well as adherence to the Balfour Beatty Code of Ethics. Review each company’s policies and procedures and make recommendations for improvements or changes when needed. Keep current with compliance requirements and changes in laws and regulations that affect each company (local, state, and federal). Advise management on the companies’ compliance with laws and regulations, and make recommendations for improvements, through detailed reports. Create and manage effective action plans in response to SpeakUp reports, audit discoveries and compliance violations. Regularly audit or assess each company’s procedures, practices, and operations to identify possible weaknesses or risk. Develop and implement new or revised compliance policies and procedures as required. Assist with the coordination and, where appropriate, delivery of training and development of employee communications in relation to ethics and compliance to ensure that the values and behaviors expressed in the Balfour Beatty Code of Ethics are fully embedded within the businesses. Help others by answering questions and responding to requests related to compliance issues. Manage, and work with the Legal and HR Departments in relation to, internal investigations and the Speak Up program within the U.S. Perform periodic audits or risk assessments to ensure the Business Integrity compliance program is adequately tailored to the risk profile across U.S. business streams. Monitor and provide recommendations regarding sufficiency of the personnel and resources within the US Business Integrity compliance function. Personal Qualities and Experience This is a role that requires the ability to influence and command respect within the organization and with peers. The individual will therefore have at least ten (10) years of experience working at an appropriately senior level, preferably with C Suite reporting lines, within a corporate ethics & compliance, finance, legal or other investigative function, and possess the following attributes: Ability to work closely with senior leaders, providing a sounding board and challenge. Ability to promote and manage significant change, demonstrating a track record of managing change through the organization. Acting as a credible partner with external stakeholders. Self-starter, highly motivated, energetic and dedicated, with a strong track record of promotion in the organizations that they have worked in. Experience in managing others, and building and leading high performing teams, with a willingness to embrace and drive best practice. Passionate about their work and adaptable. They will have strong communication skills and an ability to command respect at all levels of the organization. They must be independent and objective, but commercially astute. Excellent communicator (verbal and written) with strong inter-personal skills. Ability to analyze complex data with accuracy. Strong IT skills and knowledge of MS Office, Excel, Word etc. Sound analytical and problem-solving skills along with the ability to make timely and balanced decisions, despite uncertainties and pressures, which consider the wider strategic picture and implications for the organization. Knowledge of, and relevant experience within, the regulatory environment specific to commercial and infrastructure related construction. A law degree from an ABA accredited law school, and status as a Certified Compliance and Ethics Professional is preferred, but not required.
