The ideal candidate will have at least 6 years of experience in bankruptcy law, with a particular focus on creditors’ rights. Duties:
Creditors’ Rights & Bankruptcy Representation:
Represent clients in obtaining writs of sequestration (replevin) for secured interests in construction, agricultural, industrial, and transportation equipment. Assist clients in collecting accounts and judgments, locating assets, setting aside fraudulent transfers, and enforcing guarantees. Represent creditors in bankruptcy proceedings to recover collateral, maintain their priority as secured creditors, and protect the interests of trade creditors and lessors of both real and personal property.
Bankruptcy Claims Management:
Seek prompt and efficient relief from the automatic stay in bankruptcy proceedings. Prosecute bankruptcy claims and defend objections to those claims. Handle contests regarding the dischargeability of debts, defend against preference claims, and manage adversary proceedings.
Client Management:
Develop and maintain strong client relationships by providing timely legal advice and high-quality service. Guide strategic decision-making in bankruptcy cases.
Requirements:
At least 6 years of experience in bankruptcy law, with a strong focus on creditors' rights and bankruptcy litigation. Proven experience in handling complex bankruptcy claims and creditor representation. Ability to work independently and manage multiple matters effectively. Strong communication skills and the ability to build relationships with clients. Ability to work collaboratively in a team-oriented environment. Education:
Juris Doctor (JD) from an accredited law school. Certifications:
Active membership in the State Bar of Texas. Skills:
In-depth knowledge of creditors’ rights and bankruptcy law. Experience with writs of sequestration and other creditor enforcement actions. Strong litigation skills, with experience prosecuting and defending bankruptcy claims. Excellent legal writing, research, and analytical abilities.
