OLS is comprised of four legal teams. This position is for the Operations and Administrative Litigation team that represents the Department in hearings before the Department of Health Care Services, Office of Administrative Hearings and Appeals; Department of General Services, Office of Administrative Hearings; State Personnel Board, and other state Administrative Law forums, and provides administrative litigation support to various programs. The Operations and Administrative Litigation team also serves as house counsel to the Department's Human Resources Division (HRD), the Office of Compliance (OOC), and offices in the Directorate such as the Office of Communications and Information Technology Service Desk.Job Description And Duties

Work Location (County): Sacramento; Enhanced telework and flexibility is available for this position in accordance with the Department of General Services’ and California Department of Public Health’s telework policies.

The Attorney will represent the Department in administrative hearings involving personnel actions, appeals of actions to revoke or deny licensure of health facilities and clinics, hospital immediate jeopardy administrative penalty appeals, long term care facility citations, medical breach penalty appeals, the Stop Tobacco Access to Kids Enforcement Act (STAKE) penalty appeals, the Women, Infants and Children (WIC) Program action appeals, the Radiologic Health Program enforcement actions, failure to timely report adverse events in health facility penalty appeals, and other enforcement actions of the Department.The attached duty statement indicates whether this position is eligible for telework. All employees who telework are required to be California residents in accordance with Government Code 14200, and may be required to report to a CDPH office, when needed. Candidates who reside outside of the state of California may be interviewed; however, the selected candidate must have a primary residency in the state of California prior to appointment (and continue to maintain California residency) as a condition of employment.
