About this Role:

The Department of Health Care Services (DHCS), Office of Legal Services (OLS) is seeking a permanent, full time Attorney, Assistant Chief Counsel (Attorney, ACC) to lead the Privacy and Strategic Partnerships Section (PSPS). The Attorney, ACC position is crucial in reaching our mission of providing Californians with access to affordable, integrated, high-quality health care, including medical, dental, mental health, substance use treatment services and long-term care. Each Attorney, ACC supervises staff under their designated Section that may include Attorney IVs, Attorney Ills, Attorney Is, and paralegals/analysts as they prepare and review contracts, develop complex legal advice, and conduct varied house counsel activities. The incumbent assigns work, establishes Section priorities, and directs the overall activities of staff as they support DHCS' programs and divisions, including coordination with the Deputy Attorneys General and the Supervising Deputy Attorneys General on litigation related to or arising from these programs and divisions. The Attorney, ACC personally handles the most difficult and sensitive house counsel and litigation issues under their respective Section.

Fiscal, Financing, and Privacy Branch

- The Fiscal, Financing, and Privacy Branch (FFPB) provides advice and counsel to support DHCS program implementation related to privacy, reimbursement and financing policy, including policy development and ongoing administration; DHCS fiscal and financial administration (forecasting/costing, budget development, accounting) and strategy; oversight of local government federal reimbursement; administration of supplemental payment programs; development and implementation of Medi-Cal fee-for-service and capitated rates; collection and recovery issues; and implementing departmental cross sector strategic partnerships.

Privacy and Strategic Partnerships Section (PSPS): The PSPS advises DHCS on issues related to Privacy and Office of Strategic Partnerships lead initiatives. With respect to Privacy, the team advises on compliance with privacy provisions of the federal Health Insurance Portability and Accountability Act (HIPAA) and its implementing regulations, California Information Practices Act (IPA), and other federal and state law, regulatory, and policy privacy and confidentiality requirements. As house counsel to the Office of Strategic Partnerships, the Attorney, ACC will supervise the PSPS staff as it advises on the implementation of key Medi-Cal initiatives, such as the Justice Involved Initiative and the Children and Youth Behavioral Health Initiative.

The Attorney, ACC is highly experienced in complex legal house counsel issues and government contracts, and has a broad understanding of Medicaid, health, and technology law. The Attorney, ACC also has contact with managers throughout state service, healthcare providers, state contractors, and local, state and federal government entities, among others.

The Attorney Supervisor classification qualifies for a "Hire Above Minimum" (HAM) salary. The starting salary for the Attorney Supervisor classification will be $13,568.

Telework Information

The DHCS standard for hybrid work is a minimum of two days per week in-person and site-based and up to three teleworking days per week in accordance with DHCS’ Telework Program and Government Code sections 14200 – 14203. This position may be eligible for telework up to five days a week, contingent on operational business needs. The amount of telework is at the discretion of the Department and is subject to change.

The selected candidate will be assigned an available DHCS office closest to their residence prior to their start date. The selected candidate will be required to report to their assigned DHCS office and other DHCS locations as needed.

Business travel may be required, and reimbursement considers an employee’s designated office and residence subject to regulations and bargaining unit contract provisions. All commute expenses to the reporting location will be the responsibility of the selected candidate.
